BOARD OF ADJUSTMENT <br /> MINUTES OF DECEMBER 28, 1995 <br /> PRESENT: Sayles, Gaskill, Quackenbush, Klopp and Dreps . <br /> ALSO: Reynolds . <br /> Meeting called to order at 6: 30 P.M. in Room 2-E City-County <br /> Building by Chair Quackenbush to hold Public Hearing as <br /> published by Class II Notice. <br /> MINUTES: GASKILL/DREPS to amend minutes of November 16, <br /> 1995, RE: Appeal #2682 to read: GASKILL/SAYLES to ---- <br /> not to extend "more than" 18 inches from existing front <br /> building line. Motion carried 5-0 . <br /> GASKILL/DREPS to approve minutes of November 9, 1995 and <br /> November 16, 1995 as amended. Motion carried 5-0 . <br /> #2690 . Appeal by Frank Will for a variance from minimum <br /> required lot width at building line as provided by 10 . 09 (4) <br /> to permit residential construction on existing lot at 7625 <br /> CTH N in the NW 1/4 NE 1/4 Section 8, Town of Bristol . <br /> IN FAVOR: F. Will OPPOSED: --- COMMUNICATION: County <br /> Highway <br /> KLOPP/GASKILL to grant requested 75 . 75 feet variance from <br /> required lot width at front building line to permit <br /> residential addition as proposed. <br /> Finding of fact : <br /> 1) . Lot is only 74 . 25 feet in width at existing front <br /> building line . <br /> 2) . Existing residence relocating further back on lot to <br /> meet required setback. <br /> 3) . Relocating residence to complying lot width prevented <br /> by septic and wetland locations . <br /> 4) . Lot would be unbuildable without variance as long as <br /> public sewer is not available . <br /> CONCLUSION: <br /> 1) . Varinace preserves the zoning ordinance as much as <br /> possible without injustice to applicant . <br /> 2) . Variance is not contrary to rights of others or to the <br /> public interest . <br /> Motion carried 5-0 . <br />
