BOA 11/16/95 Minutes <br /> Page 4 <br /> #2686 . Appeal by Michael J. Monk for a Special Exception <br /> Permit as provided by Section 11 . 05 (3) to permit filling, <br /> grading, etc. , within 300 feet of Lake Waubesa being Lot <br /> #18, Block 1, Greenridge Park located North of 2775 Tower <br /> Road - Section 9, Town of Dunn. <br /> IN FAVOR: R. Zubella, M. Monk OPPOSED: --- <br /> COMMUNICATION: Town Board <br /> Gaskill/Klopp to grant, with conditions, permit to fill and <br /> grade as proposed in conjunction with construction of new <br /> residence . <br /> CONDITIONS: <br /> 1) . That plans and specifications be prepared by a licensed <br /> engineer within the scope of the application, and filed <br /> with the Zoning Department before commencement of any <br /> work. <br /> 2) . That all work be performed in compliance with approved <br /> engineering standards and all applicable governmental <br /> rules and regulations particularly Section 11 . 05 (4) of <br /> Dane County Code of Ordinances . <br /> 3) . That there be filed with the Zoning Department a <br /> Certificate of compliance by a licensed engineer at the <br /> completion of the project . <br /> 4) . Subject to all other necessary governmental agency <br /> approvals . <br /> 5) . Inspection and approval by Zoning Department upon <br /> completion of project . <br /> 6) . Permit valid April 1, 1996 thru June 30, 1996. <br /> 7) . All spoils from excavated areas to be stored, with <br /> erosion prevention measures, road side of lot to <br /> prevent erosion to lake. <br /> Finding of fact: <br /> 1) . Permit is requested for walkout lower level, driveway <br /> retaining walls and lot grading for drainage of run-off <br /> after single family residence construction. <br /> 2) . Residence construction may proceed during Winter months <br /> while additional earth disturbing awaits April 1, 1996 . <br /> 3) . Engineering provided Rod Zubella, Professional <br /> Engineer. <br /> CONCLUSION: <br /> 1) . The project as planned, with specified conditions; will <br /> not result in substantial detriment to navigable waters by <br /> erosion, sedimentation, impairment of fish or aquatic life, <br /> (00 or safe and healthful conditions . Motion carried - 5-0 . <br />
