Appeal by Carl Von Allmen for a Special Exception <br /> Permit as provided by Section 11 . 05 (3) to permit filling, <br /> grading, etc. , within 300 feet of Lake Waubesa located at <br /> 2894 Waubesa Av. being lot 28, Blk 3, Waubesa Beach 2nd <br /> Add. , Section 8, Town of Dunn. <br /> IN FAVOR: C. Von Allman OPPOSED: --- COMMUNICATION: <br /> Town Board. <br /> GASKILL/DREPS to grant, with conditions, permit to fill and <br /> grade for lot leveling and drainage as proposed. <br /> CONDITIONS: <br /> 1) . That plans and specifications be prepared by a licensed <br /> engineer within the scope of the application, and filed <br /> with the Zoning Department before commencement of any <br /> work. <br /> 2) . That all work be performed in compliance with approved <br /> engineering standards and all applicable governmental <br /> rules and regulations particularly Section 11 . 05 (4) of <br /> Dane County Code of Ordinances . <br /> 4100 3) . That there be filed with the Zoning Department a <br /> Certificate of compliance by a licensed engineer at the <br /> completion of the project. <br /> 4) . Subject to all other necessary governmental agency <br /> approvals . <br /> 5) . Inspection and approval by Zoning Department upon <br /> completion of project. <br /> 6) . Project ceases on October 15, 1995 and seeding takes <br /> place to stabilize over Winter with final completion <br /> and certification deadline of June 1, 1996. <br /> 7) . Silt fencing and erosion prevention measures remain in <br /> place until, project completion. <br /> FINDING OF FACT: <br /> 1) . Applicant owns adjoining lot, with residence on, and <br /> project is intended to relieve standing water problems . <br /> 2) . Proposed addition to residence lot will generate fill <br /> for vacant lot. <br /> 3) . Engineering provided by Doak Christianson, P.E. <br /> CONCLUSION: <br /> 1) . The project as planned, with specified conditions; will <br /> not result in substantial detriment to navigable waters by <br /> erosion, sedimentation, impairment of fish or aquatic life, <br /> or safe and healthful conditions .
