Appeal by Jim Laufenberg for a variance from required setback from road as provided by Section 10 . 17 (2) to permit addition to existing barn at 1071 CTH PB in the NE 1/4 NW 1/4 Section 15, Town of Montrose. In Favor: J. Laufenberg Opposed: --- Communication: Town Board, County Highway. Gaskill/Sayles to grant with condition variance of 25 feet from required setback to centerline CTH PB to permit barn addition to existing dairy operation. CONDITIONS: 1) . A barn addition shall be removed at the owner' s expense if future road improvement requires additional right-of-way. Finding of fact: 1) . Proposed addition will be set 14 feet further away from centerline than does existing barn. 2) . Efficient milking operation requires proposed building location. 3) . Barn sandwiched between road, hog buildings, residence and tributary to Sugar River. 4) . Other nonconforming Ag-buildings in immediate area and exist barn has variance (#998 6/24/81) for prior addition. CONCLUSION: 1) . Variance preserves the zoning ordinance as much as possible without injustice to applicant. 2) . Variance is not contrary to rights of others or to the public interest . Motion carried - 5-0 . #2655. In Favor: D & J Craig Opposed: --- Communication: --- Dreps/Gaskill to hold requested permit in abeyance until August Hearing pending submittal of additional materials . Motion carried - 5-0 .
