4.1„ <br /> BOA MINUTES 7/27/95 <br /> Page 5 <br /> Appeals From Previous Hearings: <br /> #2639. Madison Metro Sewerage - Verona - 6/22/96 <br /> Dreps/Gaskill to grant, with conditions permit to fill and <br /> grade for sewer main construction within 300 feet of Badger <br /> Mill Creek. <br /> Conditions: <br /> 1) . That plans and specifications be prepared by a licensed <br /> engineer within the scope of the application, and filed with <br /> the Zoning Department before commencement of any work. <br /> 2) . That all work be performed in compliance with approved <br /> engineering standards and all applicable governmental rules <br /> and regulations particulary Section 11 . 05 (4) of Dane County <br /> Code of Ordinances . <br /> 3) . That there be filed with the Zoning Department a <br /> Certificate of Compliance by a licensed engineer at the <br /> completion of the project. <br /> 4) . Subject to all other necessary governmental agency <br /> approvals . <br /> 5) . Completion and Certification deadline October 1, 1995. <br /> 6) . Emergency winter stabilization measures implemented if <br /> intended to go beyond October 1, 1995 deadline. <br /> Finding of fact: <br /> 1) . New sewer main connecting City of Verona to Madison <br /> Metro Sewerage Treatment Facility. <br /> 2) . Only small portion of project is within 300 feet of <br /> Badger Mill Creek. <br /> 3) . Engineering by Bill Erickson professional engineer of <br /> Applied Technologies, Inc. <br /> 4) . MMSD has received approvals from Dane County; ECP-3 <br /> #143 and FP/WL 111P, DNR; NR 216, CH 30 PMT and Army Corps <br /> Nationwide Permit . <br /> CONCLUSION: <br /> 1) . The project as planned, with specified conditions; will <br /> not result in substantial detriment to navigable waters by <br /> erosion, sedimentation, impairment of fish or aquatic life, <br /> or safe and healthful conditions .
