BOARD OF ADJUSTMENT MINUTES <br /> June 22, 1995 <br /> PRESENT: Gaskill, Quackenbush, Klopp, Sayles and Dreps. <br /> ALSO PRESENT: Gregorius and Reynolds. <br /> Meeting called to order at 6: 30 P.M. by Chairman Quackenbush in <br /> Room 2-E City-County Building to hold public hearing as published <br /> by Class II Notice. <br /> GASRILL/RLOPP to amend minutes of May 25, 1995 - RE: Appeal #2629 <br /> "conditions" 2) . to read "East" property line, "finding of fact" <br /> 3) . Owner immediately to the West is in favor and add: 4) . The <br /> balance of the property lines to the West and the South shall <br /> comply with the standards of 10. 16 (7) Dane County Code of <br /> Ordinances. Motion carried - 5-0. <br /> KLOPP/GASRILL to approve minutes of May 18 and minutes of May 25, <br /> 1995 as amended. Motion carried 5-0. <br /> #2637. Appeal by William and Margaret Pulcine for a variance from <br /> required setback from road as provided by Section 10. 17 (4) to <br /> permit deck addition to existing residence at 133 Seminole Drive <br /> being Lots 7 & 8, Block #6, Hickory Hills Estates - Section 25, <br /> Town of Albion. <br /> Co IN FAVOR: M. Pulcine OPPOSED: --- COMMUNICATION: --- <br /> GASRILL/DREPS to grant variance of 12 feet from required setback <br /> to right-of-way of Seminole Drive to permit deck/entry way add to <br /> existing residence. <br /> FINDINGS OF FACT: <br /> 1) . Deck will not extend near to right-of-way as does existing <br /> residence. <br /> 2) . Property is last residence on dead-end road. <br /> 3) . Property slopes away from road and applicant's have added <br /> retaining walls to stabilize. <br /> 4) . Porch rebuild and deck project do not present traffic hazard. <br /> 5) . Property is in an area of numerous non-conforming structures <br /> with numerous variances being granted. <br /> CONCLUSIONS OF LAW: <br /> 1) . Variance preserves the zoning ordinance as much as possible <br /> without injustice to applicant. <br /> 2) . Variance is not contrary to rights of others or to the public <br /> interest. <br /> Motion carried - 5-0. <br /> #2638 . Appeal by Dane County Parks Department for a Special <br /> Exception Permit as provided by Section 11. 05 (3) to permit filling, <br /> grading, etc. , within 300 feet of the Yahara River and Lake Kegonsa <br /> in the N 1/2 SW 1/4 - Section 13 , Town of Dunn. <br /> IN FAVOR: J. Mueller OPPOSED: --- COMMUNICATION: Town Board <br /> thaw RLOPP/SAYLES to grant with conditions permit to fill and grade as <br /> proposed. <br />
