BOA MINUTES 6/22/95 PAGE 2 CONDITIONS: 1) . That plans and specifications be prepared by a licensed engineer within the scope of the application, and filed with the Zoning Department before commencement of any work. 2) . That all work be performed in compliance with approved engineering standards and all applicable governmental rules and regulations particularly Section 11. 05 (4) of Dane County Code of Ordinances. 3) . That there be filed with the Zoning Department a certificate of compliance by a licensed engineer at the completion of the project. 4) . Subject to all other necessary governmental agency approvals. 5) . Inspection and approval by Zoning Department upon completion of project. 6) . Deadline for seeding is October 1, 1995 and completion and certification deadline is November 1, 1995. FINDINGS OF FACT: 1) . Project needed for handicap accessibility, blacktop removal and drainage away from proposed construction. 2) . Walkways and handicap accessible piers to be built. 3) . Blacktop removed and blackdirt and seed will replace. 4) . A sheriff emergency boat launch site will also be constructed. CONCLUSIONS OF LAW: 1) . The project as planned with specified conditions; will not result in substantial detriment to navigable waters by erosion, sedimentation, impairment of fish or aquatic life, or safe and healthful conditions. Motion carried - 5-0. #2639. Appeal by Madison Metropolitan Sewerage District for a Special Exception Permit as provided by Section 11. 05 (3) to permit filling, grading, etc. , within 300 feet of Badger Mill Creek in the NW 1/4 - Section 13 and NE 1/4, NW 1/4 and SW 1/4 - Section 14, Town of Verona. IN FAVOR: N. Paschke OPPOSED: --- COMMUNICATION: County Highway, D.N.R. , Army Corps GASRILL/DREPS to hold request until July Hearing pending submittal of additional materials. Appeal by MEM dba Stop-N-Go for a variance from required setback pump from road as provided by Section 10. 17 (2) to permit canopy over gas islands as constructed at 5305 CTH M - in the NW 1/4 NW 1/4 - Section 28, Town of Westport. IN FAVOR: L. Zinger OPPOSED: --- COMMUNICATION: Town Board GASRILL/DREPS to deny requested Variance from required setback to right-of-way to allow canopy over gas islands as constructed. FINDINGS OF FACT: 1) . Variance #2489 granted, 3/24/94 from required setback to CTH M to permit said canopy.
