BOA MINUTES 8/22/02 <br /> PAGE 1 <br /> BOARD OF ADJUSTMENT <br /> MINUTES OF 8/22/02 <br /> PRESENT: Long, Sayles, Klopp and Ross <br /> ALSO: Reynolds <br /> Meeting called to order at 6:30 P.M. in Room 2-F City-County building,by Chair Ross, <br /> to hold Public Hearing as published by Class II Notice. <br /> MINUTES: Klopp/Sayles to approve minutes of July 18 and July 25, 02 as <br /> submitted. Motion carried. 4—0. <br /> AUGUST PUBLIC HEARING ITEMS: <br /> #3195. Appeal by Eugene & Gloria Gryska for a variance from required setback from <br /> normal high watermark as provided by Section 11.03(2)to permit proposed additions to <br /> existing single family residence at 2204 Colladay Point Drive being Lot#7 and Part Lot <br /> #6, Colladay's Point Section 23, Town of Dunn. <br /> IN FAVOR: E. & G. Gryska OPPOSED: - COMMUNICATION: Town Board, <br /> State Historical Society <br /> LONG/SAYLES to deny variance to allow bay window and balcony addition to second <br /> floor. Motion carried—4-0. <br /> KLOPP/ROSS to grant variances of 22± feet from required setback to normal highway <br /> watermark to permit screen porch with deck above as proposed. Motion carried 3-1 <br /> (Long,no). <br /> Finding of fact: <br /> 1). Property has previous variance for setback to normal high watermark for additions <br /> approved in 1984 (Variance#1260 5/24/84). <br /> 2). Structure has presently a raised deck which applicant proposes enclosing and <br /> construct a deck atop. <br /> 3). Bay window encroachment totals 1.75 feet beyond previous approved Variance <br /> (#1260). <br /> 4). Property is in an area of numerous non-conforming structures with numerous <br /> variances granted. <br /> Conclusion: <br /> 1). Variance preserves the zoning ordinance as much as possible without injustice to <br /> applicant. <br /> 2). SCREEN PORCH: Variance is not contrary to rights of others or to the public <br /> interest. <br /> 3). BAY WINDOW: Unnecessary hardship was not proven. <br />
