BOA MINUTES 8/22/02 <br /> PAGE 2 <br /> #3196. Appeal by Barton C. Jackson for a variance from required setback from road and <br /> sideyard as provided by Sections 10.17(3) and 10.07(7) to permit division of platted lots <br /> by Certified Survey Map at 6789 Depot Street being Lot#8 and Part Lot#9, Block 4, <br /> Village of Windsor Section 29, Town of Windsor. <br /> IN FAVOR: B. Jackson OPPOSED: - COMMUNICATION: - <br /> SAYLES/LONG to grant with condition variances from setback from road and required <br /> sideyard to permit lot division by Certified Survey Map as proposed. <br /> Conditions: <br /> Subject to receiving communication, in support, from Township. <br /> Finding of fact: <br /> 1). Applicant owns what was previously 2 platted lots in the unincorporated Village of <br /> Windsor. <br /> 2). Subject property is Lot#8 and part of Lot#9, Block#4, Village of Windsor and has <br /> an existing residence. <br /> 3). Applicant's property was legally combined as 1 lot by previous owner and Certified <br /> Survey Map required to separate. <br /> 4). Setback and sideyard encroachments pre-date Zoning Ordinance and lot division <br /> uneffected by encroachments. <br /> Conclusion: <br /> 1). Variance is not contrary to rights of others or to the public interest. <br /> 2). Variance preserves the Zoning Ordinance as much as possible without injustice to <br /> applicant. <br /> Motion carried—4-0. <br /> #3197. Appeal by Chris &Ellen Elinchev for a variance from required setback from <br /> roads as provided by Section 10.17(3) to permit proposed addition to existing residence at <br /> 2255 County Highway Z in the NW 1/4 SE 1/4 Section 19, Town of Blue Mounds. <br /> IN FAVOR: C. Elinchev OPPOSED: - COMMUNICATION: Town Board <br /> W. Hitzemann <br /> ROSS/SAYLES to grant with condition Variance of 47.9 feet from required setback to <br /> centerline of Town Road to permit addition to existing residence as proposed. <br /> Condition: Subject to a signed agreement between Town and affected neighbor of <br /> proposed road relocation to remove addition from right-of-way. <br /> Finding of fact: <br /> 1). Residence is a former cheese factory and lies within required setback of two roads. <br /> 2). Cheese factory built in 1852 and former farm drive deeded to Township the 1930's. <br /> 3). Proposed addition to be utilized as an office/studio. <br /> 4). Applicant's buildable area limited by hillside on the West, septic on the South and <br /> road setbacks North and East. <br />
