Appeal by Florian& Charlene Dahmen for variances from required setback from <br /> road and maximum size and height of accessory buildings as provided by Sections <br /> 10.17(3), 10.04(1) and 10.07(3)to permit re-division of lots with existing buildings by <br /> Certified Survey Map at 7076 Town and Country Lane in the NW 1/4 SW 1/4 Section 15, <br /> Town of Springfield. <br /> IN FAVOR: C. Dahmen OPPOSED: - COMMUNICATION: Wis DOT. <br /> R. Williamson <br /> SAYLES/KLOPP to grant Variances of 23.4 feet from required setback to right-of-way <br /> of Town of Country Lane. Also, to grant Variances from maximum height and area of <br /> accessory buildings to permit lot reconfiguration by Certified Survey Map. <br /> Finding of fact: <br /> 1). Due to relocation of US Highway 12 existing Certified Survey Map lots needed to be <br /> reconfigurated and rezoned. <br /> 2). Existing duplex lot is proposed to expand and absorb 2 accessory buildings. <br /> too 3). Accessory buildings were conforming as constructed, formerly having RH-3 Zoning. <br /> 4). Setback encroachment will go away as Town and Country Lane is to be relocated. <br /> 5). Rezone Petition#8409 4/23/02 P.H. to RH-1 and R-3A was approved by County <br /> Board and presently pending Variance and recording of Certified Survey Map. <br /> Conclusion: <br /> 1). Variance preserves the Zoning Ordinance as much as possible without injustice to <br /> applicant. <br /> 2). Variance is not contrary to rights of others or to the public interest. <br /> Motion carried—4-0. <br /> #3199. Appeal by Lawrence Brokaske to appeal the interpretation of the Dane County <br /> Zoning Administrator as it pertains to Substantial Farm Income Reviews as provided by <br /> Sections 10.04 and, 10.123(1) and(2), and 10.25(2) Dane County Code of Ordinances. <br /> IN FAVOR: No Appearances OPPOSED: None COMMUNICATION: <br /> None <br /> LONG/ROSS to postpone until end of hearing. Motion carried—4-0. <br />
