BOA MINUTES 7/25/02 <br /> PAGE 1 <br /> BOARD OF ADJUSTMENT <br /> MINUTES OF 7/18/02 <br /> p <br /> PRESENT: Sayles, Kay, and Klopp <br /> ALSO: Reynolds <br /> Meeting called to order at 6:30 P.M. in Room 2-E City-County Building, by Chair Ross <br /> to hold Public Hearing as published by Class II Notice. <br /> MINUTES: KLOPP/SAYLES to approve minutes of 6/20/02 and 6/27/02 as submitted. <br /> Motion carried—4-0. <br /> JULY PUBLIC HEARING ITEMS: <br /> #3193. Appeal by Donald M. Bush for a variance from required sideyard and maximum <br /> square footage of accessory building as provided by Sections 10.04(1) and 10.05(7) to <br /> permit proposed addition to existing accessory building at 502 Edgerton Road being <br /> Outlot 72, Village of Albion Assessor's Plat —Section 27, Town of Albion. <br /> IN FAVOR: D. Bush OPPOSED: --- COMMUNICATION: --- <br /> SAYLES/LONG to deny both side yard and square footage variance to permit garage <br /> addition as proposed. <br /> tor <br /> NOTE: Board leaves open the option to reconsider the square footage issue when and if <br /> addition to residence is made. <br /> Finding of fact: <br /> 1). Applicant proposes to add a 22' x 22' garage to existing structure. <br /> 2). Proposed addition will provide a 5 foot sideyard while ordinance requires a minimum <br /> of 10 feet. <br /> 3). Applicant has a 1± acre lot and numerous locations on lot, not requiring a variance. <br /> 4). Applicant has small residence with limited storage and garage needed for boat and <br /> vehicles. <br /> Conclusion: <br /> 1). Unnecessary hardship was not proven. Motion carried—4-0. <br /> #3194.
