BOA MINUTES 7/25/02 <br /> PAGE 2 <br /> variance of 2.5 feet from required right sideyard to permit alteration of existing 1st floor, <br /> to exclude a 2.5 foot kitchen expansion on the streetside and to exclude lakeside porch, <br /> also only variance allowed for is 2nd story is for rebuild of existing chimney. Also, to <br /> grant variance to allow addition/alteration of existing nonconforming residence to exeed <br /> 50% of assessed valuation, as proposed. <br /> Finding of fact: <br /> 1). Applicant has existing 2 story residence constructed in 1918, which is in need of <br /> upgrade. <br /> 2). Plan is to rehabilitate 1St floor, remove existing 2nd story and construct anew. <br /> 3). Existing sun porch to be removed, as it sits atop post foundation, and reconstruct. <br /> 4). Lot is 40 foot wide and requires 5 foot minimum sideyard setbacks per 10.16(5) Dane <br /> County Code of Ordinances. <br /> 5). 1950 valuation of residence was $4000 which would allow up to $2000 worth of <br /> addition/alteration. <br /> 6). Property is in an area of numerous nonconforming structures with numerous <br /> variances granted. <br /> Conclusion: <br /> 1). Variance is not contrary to rights of others or to the public interest. <br /> 2). Variance preserves the zoning ordinance as much as possible without injustice to <br /> applicant.
