BOA MINUTES 12/19/02 <br /> PAGE 3 <br /> #3223. Appeal by The Town of Dunn on behalf of numerous property owners for <br /> variances from required lot areas and widths as provided by Section 11.03(1) and <br /> 10.05(4) to bring existing lots into compliance after road vacations at 1924 through 1946 <br /> Barber Drive being Lots #20 through#31 Rock Elm Park Extension, Lots #20A through <br /> #31A Addition to Rock Elm Park Extension and adjacent lands in the NW 1/4 SE 1/4 <br /> Section 26 Town of Dunn; also at 2860 Lakeside Street being Lot 6, Block 1 Waubesa <br /> Beach 1st Addition and adjacent lands in the NE 1/4 NW 1/4 Section 8, Town of Dunn. <br /> IN FAVOR: R. Gausman OPPOSED: --- COMMUNICATION: Town Board, <br /> Historical Society <br /> KAY/ROSS to grant variances from minimum required lot areas and lot widths to permit <br /> vacated roads to be added to existing parcels as proposed. <br /> Finding of fact: <br /> 1). Town of Dunn has vacated portions of 2 roads, Kegonsa Boulevard and Center <br /> Avenue. <br /> 2). The means of adding lands to lots in a recorded plat is by CSM or replat. <br /> 3). Center Avenue was platted in 1909 and Kegonsa Boulevard was platted in 1905. <br /> 4). Section 10.07(4) (R-3 Residence District)Dane County Code of Ordinance requires <br /> minimum lot area of 15,000 square feet and 100 foot minimum lot width. <br /> fr Conclusion: <br /> 1). Variance preserves the Zoning Ordinance as much as possible without injustice to <br /> applicant. <br /> 2). Variance is not contrary to rights of others or to the public interest. <br /> Motion carried—5-0. <br /> #3224. Appeal by Fred & Candace Groth for a variance from required setback from road <br /> as provided by Section 10.17(2) to permit new single family residence construction <br /> Southeast of 2306 County Highway AB being Lot#2, CSM #8309 in the SE 1/4 NW 1/4 <br /> Section 23, Town of Dunn. <br /> IN FAVOR: F & C Groth, R. Gausman OPPOSED: --- COMMUNICATION: <br /> Town Board <br /> SAYLES/ROSS to grant with condition a variance of 8.33 feet from minimum required <br /> setback to right-of-way of County Highway AB to permit residence construction as <br /> proposed. <br /> Conditions: <br /> That garage floor elevation not exceed 903.75 feet mean sea level, as agreed upon by <br /> applicant and township. Also, that structure maintain the 75 foot required setback from <br /> normal high watermark. <br /> Finding of fact: <br /> 1). Applicant proposes to build at the 75 foot setback from normal high watermark due <br /> to severe slope rather than at the minimum required average setback of 69 feet. <br />
