BOA 1/24/02 MINUTES <br /> PAGE 1 <br /> BOARD OF ADJUSTMENT MINUTES <br /> January 24, 2002 <br /> PRESENT: Sayles, Long, Ross, Kay and Klopp <br /> ALSO: Reynolds <br /> Meeting called to order at 6:30 P.M. in Room 2-F City-County Building by Chair Ross to <br /> hold Public Hearing as published by Class II Notice. <br /> MINUTES: KAY/KLOPP to approve minutes of December 13 and December 20, 2001 <br /> as submitted. Motion carried 5-0. <br /> JANUARY HEARING ITEMS: <br /> #3165. Appeal by Wisconsin Department of Transportation for a variance from required <br /> setback from road as provided by Section 10.17(1) to permit structures within highway <br /> right-of-way as constructed in the Northeast quadrant of intersection US Highway 51 <br /> and 1-94 in part of the SW 1/4 SW 1/4 Section 4, and NW 1/4 NW 1/4 Section 9, Town <br /> of Burke. <br /> IN FAVOR: B. Roberts OPPOSED: -- COMMUNICATIONS: -- <br /> r KAY/LONG to hold request in abeyance, not beyond March Hearing, to allow for a <br /> Corporation Counsel opinion RE: the Board's authority to variance within right-of-ways, <br /> permitted uses and appropriate locations within right-of-ways. <br /> #3166. Appeal by James Breunig et al. for a variance from required sideyard and <br /> rearyard as provided by Sections 10.07(7) and(8) to permit addition of lands and lot <br /> division by C.S.M. at 8894 County Highway Y, 7200, 7202 and 7208 Mama Road being <br /> Lot#1 CSM#2768 and adjacent lands in the SE 1/4 SW 1/4 Section 16, Town of <br /> Roxbury. <br /> IN FAVOR: J. Breunig OPPOSED: -- COMMUNICATIONS: -- <br /> KAY/SAYLES to grant variances with conditions of 1.8 feet from required sideyard for <br /> both proposed Lot 2 and Lot#3 to allow lot division between 2 existing residences also, <br /> to grant a variance of 5.7 feet from required rearyard for proposed Lot#4. <br /> Condition: <br /> That the R-3 rezone application, currently pending#8325 1/22/02 Public Hearing,be <br /> approved and that garage shown as, "to be removed,"on preliminary C.S.M., be <br /> removed. <br /> Finding of Fact: <br /> 1). 2 Houses (proposed Lots 2 & 3)were divided off the farm in 1978 leaving 2 <br /> residences on 1 lot. (CSM#2768). <br />
