BOA 1/24/02 MINUTES <br /> PAGE 3 <br /> 1). Proposed addition is intended to be sunroom and entry stairs. <br /> tro 2). Proposed addition is further from highway than much of existing residence. <br /> 3). Property has had 2 previous variances from setback to centerline of State Highway 78 <br /> (Variance#2889 11/97 and Variance#226 7/73). <br /> 4). Original residence built in 1910 and pre-dates road becoming a State Highway. <br /> Conclusion: <br /> 1). Variance preserves the zoning ordinance as much as possible without injustice to <br /> applicant. <br /> 2). Variance is not contrary to rights of others or to the public interest. <br /> Motion carried 5-0. <br /> #3169. Appeal by Marc and Danielle Rhiner for a variance from required setback from <br /> normal high watermark as provided by Section 11.03(2) to permit deck addition to <br /> residence as constructed at 8781 County Highway G being Lot#1, C.S.M. #8587 in the <br /> SE 1/4 SW 1/4 Section 4 and NE 1/4 NW 1/4 Section 9, Town of Primrose. <br /> IN FAVOR: M. Rhiner OPPOSED: -- COMMUNICATIONS: <br /> Town Board <br /> SAYLES/ROSS to grant a variance of 4 feet± from required setback to normal high <br /> watermark to permit decking, not to exceed 4 feet from rear building line. <br /> Finding of fact: <br /> 1). Applicant obtained Zoning Permit#ZP 2000-969) for new single family residence <br /> with deck. <br /> 2). Residence was located at the minimum required setback and deck, as constructed, <br /> encroaches into setback area. <br /> 3). Northeast end of residence could accommodate large deck area with desired view. <br /> 4). Limited deck offers emergency exit from rear of residence. <br /> 5). Property is a 6.5 acre lot with its Northerly border being the West branch of the Little <br /> Sugar River. <br /> Conclusion: <br /> 1). Variance is not contrary to rights of others or the public interest. <br /> 2). Variance preserves the zoning ordinance as much as possible without injustice to the <br /> applicant. <br /> Motion carried, —4-1 (Long, no) <br /> #3170. Applicant has an egg producing business and constructed an egg breaking and <br /> tirr sorting building across A-B Zoning boundary. <br />
