Cody OPPOSED: --- COMMUNICATION: Town <br /> Board <br /> KLOPP/KAY to deny requested Variance of 1.7± feet from required maximum height of <br /> accessory building to allow storage building as constructed. <br /> Finding of fact: <br /> 1). Applicant constructed an accessory building, under Zoning Permit ZP 2002-876, in <br /> the R-1A Residence District. <br /> 2). Zoning permit was conditioned upon structure not exceeding 12 foot maximum <br /> average height limit. <br /> 3). Applicant was given a stop work order by Dane County and then completed project <br /> after being given permission by Township. <br /> 4). Applicant desires additional height in order to store motor home in the 30'x 50' shed. <br /> 5). A rezone to another district (A-2(1))will allow accessory building with a 16 foot <br /> maximum average height and variance would not be needed. <br /> Conclusion: <br /> 1). Unnecessary hardship was not proven. Motion carried 5-0. <br /> #3213. Appeal by Phillip & Betty Zibell for a variance from required setback from road <br /> as provided by Section 10.17(1) to permit accessory building as constructed at 2571 State <br /> Highway 73 in the SE 1/4 NE 1/4, Section 16, Town of Christiana. <br /> IN FAVOR: J. Lowry OPPOSED: --- COMMUNICATION: --- <br /> SAYLES/LONG to deny requested Variance from required setback to State Highway 73 <br /> to permit residential garage as constructed. <br /> Finding of fact: <br /> 1). Applicant constructed residence garage without required zoning permit. <br /> 2). Applicant's contractor, after being issued a stop work order completed structure after <br /> being advised of locational requirements. <br /> 3). Applicant has previous variance(#1684, 4/28/88 PH) from required setback to road, <br /> for a residential addition. <br /> 4). Applicant's property is 5 acres with existing residence and barn. Motion carried 5-0. <br /> Conclusion: <br /> 1). Unnecessary hardship was not proven. <br /> Motion carried 5-0. <br /> #3214. Appeal by Whitfield Square Corporation for variances from required setback <br /> from road and setback from normal high watermark as provided by Section 10.17(5) and <br /> 11.03(2) to permit residential additions as proposed at 2057 Skyline Drive being Lot#13, <br /> Kegonsa Grove, 1st Addition Section 29, Town of Pleasant Springs. <br />
