BOA 12/20/01 MINUTES <br /> PAGE 1 <br /> BOARD OF ADJUSTMENT MINUTES <br /> December 20, 2001 <br /> PRESENT: Sayles, Long, Ross, Kay and Klopp <br /> ALSO: Reynolds <br /> Meeting called to order at 6:30 P.M. in Room 2-F City-County Building by Chair Ross to <br /> hold Public Hearing as published by Class II Notice. <br /> Minutes KLOPP/KAY to approve minutes of November 8 and November 15, 2001 as <br /> submitted. Motion carried—5-0. <br /> DECEMBER HEARING ITEMS: <br /> #3163. Appeal by Jerard and Amy Jensen for a variance from required setback from road <br /> as provided by Section 10.17(2) to permit addition to existing residence at 5225 County <br /> Highway KP being Lot#1, CSM#6306 in the SE 1/4 NE 1/4 Section 28, Town of Berry. <br /> IN FAVOR: J. &A. Jensen OPPOSED: --- <br /> COMMUNICATION: Dane County Environmental Health, County Highway, Town <br /> 40, Board. <br /> SAYLES/KAY to grant, with condition, variance of 12 feet from required setback to <br /> right-of-way of County Highway KP to permit residential addition as proposed. <br /> Condition: <br /> The addition shall removed at the owner's expense if future road improvement requires <br /> additional right-of-way. <br /> Finding of fact: <br /> 1). Original residence constructed in 1905. <br /> 2). Residence backs up to a rock ridge on North and West sides while septic and well <br /> occupy South and East sides. <br /> 3). Applicant proposes 2-story addition consisting of bedroom,playroom, music room <br /> and office. <br /> 4). Roof of porch serves as second story emergency exit. <br /> Conclusion: <br /> 1). Variance preserves the zoning ordinance as much as possible without injustice to <br /> applicant. <br /> 2). Variance is not contrary to rights of others or to the public interest. <br /> Motion carried 5-0. <br />
