BOA MINUTES 4/26/01 <br /> PAGE 1 <br /> I <br /> BOARD OF ADJUSTMENT <br /> MINUTES OF APRIL 26,2001 <br /> PRESENT: Klopp,Ross, Kay, and Long <br /> ALSO: Reynolds <br /> Meeting called to order at 6:30 P.M. by Chair Kay in Room 2-F City-County Building to <br /> hold Public Hearing as published by Class II Notice. <br /> MINUTES: Klopp/Ross to approve minutes of March 15 and March 22nd 2001 as <br /> submitted. Motion carried. 4—0. <br /> APRIL PUBLIC HEARING ITEMS: <br /> #3125. Appeal by Wisconsin Gas Company for a variance from required setback from <br /> road as provided by Section 10.17(1)to permit gas pipeline metering building located <br /> West of 2505 State Highway 19 in the NE 1/4 NW 1/4 Section 9, Town of Sun Prairie. <br /> IN FAVOR: K. Brekke OPPOSED: --- COMMUNICATION: --- <br /> Cw Ross /Klopp to grant,with condition. a variance of 11 +/- feet from required setback <br /> to centerline of State Highway 19 to permit gas metering building located 2 feet north of <br /> existing metering building as proposed. <br /> CONDITION: The structure shall be removed at owners expense if future road <br /> improvements require additional right-of-way. <br /> Finding of fact: <br /> 1). Property is a gate station for natural gas pipeline. <br /> 2). Proposed building to be located further from right-of-way than existing building. <br /> 3). Existing building is non-conforming relative to setback to centerline. <br /> 4). Structure is a 6' x 8' unit which will house a chromatagraph used to measure flow <br /> and BTU's of gas. <br /> 5). Fire and safety codes require minimum separation with other buildings,which restrict <br /> buildable area. <br /> Conclusion: <br /> 1). Variance preserves the zoning ordinance as much as possible without injustice to <br /> applicant. <br /> 2). Variance is not contrary to rights of others or to the public interest. <br /> Motion carried. 4 - 0. <br /> tir <br />
