BOA 10/25/01 Minutes <br /> Page 1 <br /> BOARD OF ADJUSTMENT MINUTES <br /> October 25,2001 <br /> PRESENT: Sayles, Long,Ross, and Klopp <br /> ALSO: Reynolds <br /> Meeting called to order at 6:30 P.M. in Room#2-F City-County Building by Chairperson <br /> Ross to hold Public Hearing as published by Class II Notice. <br /> MINUTES: Klopp/Long to amend minutes of 9/20/01 RE: Appeal# 3143, Bruce Co. <br /> to read, under Conclusion:Motion Carried 3—1, (Long—no, Sayles—recused) Motion <br /> Carried 4—0. <br /> Klopp /Long to approve minutes of 9/13 as submitted and 9/20/01 as amended. Motion <br /> carried-4-0. <br /> OCTOBER HEARING ITEMS: <br /> #3155. Appeal by Richard &JoAnne Hinrichs for a variance from required minimum lot <br /> width at building setback line as provided by Sections 10.12(5) and 10.05(4) in the <br /> SW 1/4 NW 1/4 Section 9, Town of Middleton. <br /> IN FAVOR: R. Hinrichs, L. Theis OPPOSED: ---- COMMUNICATION: <br /> Town Board <br /> Klopp/Ross to grant a variance of 14.67 ft from minimum required lot width to permit <br /> residential lot creation by CSM, as proposed. <br /> Finding of fact: <br /> 1). Applicant owns 40 acres and wishes to create additional lot for family member. <br /> 2). County Ordinance requires that lots for residential use be 100 feet in width and not <br /> less than 20,000 square feet in area. <br /> 3). Applicant has an additional 384± feet of frontage on Wayside Road available to <br /> create a 100-foot lot. <br /> 4). Applicant will need a variance from Dane County Subdivision Ordinance, in <br /> addition, for lot width. <br /> 5). Actual variance will be less than 14.67 ft, due to width of lot is determined at building <br /> setback line. <br /> 6). It is anticipated that no further variances will be needed for placement of residence on <br /> lot. <br /> Conclusion: <br /> 1). Variance preserves the zoning ordinance as much as possible without injustice to <br /> applicant. <br /> 2). Variance is not contrary to rights of others or to the public interest. <br /> Motion carried- 4-0. <br /> tir <br />
