BOARD OF ADJUSTMENT <br /> tor MINUTES OF SEPTEMBER 28,2000 <br /> PRESENT: Klopp, Long, Sayles, and Kay <br /> ALSO: Reynolds, Bartlett <br /> Meeting called to order at 6:30 P.M. in Room#2-F City-County Building by Chairman <br /> Kay to hold Public Hearing as published by Class II Notice. <br /> Klopp/Sayles to amend minutes of 8/24/00 meeting to read: (Appeal #3102: Motion <br /> carried 4 - 0.)Motion carried 3 - 1. Long - no. <br /> Sayles/Klopp to approve minutes of 8/17/00 and 8/24/00 as amended. <br /> Motion carried 4 - 0. <br /> SEPTEMBER Public Hearing Items: <br /> #3103. Appeal by Jay Gould for a variance from minimum distance between signs as <br /> provided by Section 10.74(9)to permit off-premise directory sign at 5655 Lincoln Road <br /> in the NW 1/4 NE 1/4 Section 16, Town of Oregon. <br /> IN FAVOR: J. Gould OPPOSED: -- <br /> Cr COMMUNICATION: Town Board <br /> Sayles/Klopp to grant, with condition, a variance of 785 feet from the minimum <br /> distance between signs to permit directory sign as presented. <br /> Condition: <br /> 1). Sign to be as presented: 8' long, 4' wide, 10' high, unlighted, and posts may be taller. <br /> Finding of fact: <br /> 1). Applicant proposes an 8' long x 4' wide x 10' high, unlighted, directory sign for his <br /> nursery business. <br /> 2). The proposed directory sign to be located 535 feet from an existing farm sign and <br /> outside of the A-B, Agri-Business District on which applicant has his business. <br /> 3). The recently zoned area for applicant's business, was kept to a minimum so as not to <br /> reduce agriculture zoning, did not include location of sign. <br /> 4). Agricultural zoning is for growing nursery stock while A-B zoned area is for retail <br /> sales. <br /> 5). Intent of ordinance is to maintain agriculturally zoned lands and rezone to <br /> accommodate signage violates that intent. <br /> Conclusion: <br /> 1). Variance preserves the zoning ordinance as much as possible without injustice to <br /> applicant. <br /> 2). Variance is not contrary to rights of others or to the public interest. <br /> tor Motion carried - 4 - 0 . <br />
