Gehrke OPPOSED: -- <br /> COMMUNICATION: Town Board <br /> Long/Sayles to grant with condition a variance of 10 feet from the minimum required <br /> setback to Tuggle Lane to permit addition to single family residence as proposed. <br /> Conditions: <br /> 1).Porch remodel/addition to utilize the existing footprint and foundation. <br /> Finding of fact: <br /> 1). Applicant proposes new pitched roof and screen porch remodeling on same <br /> foundation. <br /> 2). Certified Survey Map #1243 created non-conforming location for the existing, single- <br /> family residence. <br /> 3). Addition/remodel to be no closer to Tuggle Lane right-of-way line than previous <br /> porch in need of repair. <br /> Conclusion: <br /> 1). Variance preserves the zoning ordinance as much as possible without injustice to <br /> applicant. <br /> 2). Burrill OPPOSED: -- <br /> COMMUNICATION: Town Board <br /> Sayles/Klopp to deny a variance of 3 feet from the minimum required sideyard to permit <br /> entry, to residence, as constructed. <br /> Finding of fact: <br /> 1). Applicant has constructed a 6'x 8.5' side-door, entry addition to new single family <br /> residence. <br /> 2). Floor plans for the residence showed both side door entrances, however no indication <br /> that they would be above grade. <br /> 3). Filling and grading permit issued 7/25/00 for the retaining walls. <br /> 4). Design options exist to eliminate the variance request. <br /> Conclusion: <br /> 1). Unnecessary hardship was not proven. <br /> Motion carried 4 - 0 . <br />
