BOA MINUTES 8/24/00 <br /> PAGE 1 <br /> BOARD OF ADJUSTMENT <br /> MINUTES OF AUGUST 24, 2000 , <br /> PRESENT: Long, Sayles, Ross, and Klopp <br /> ALSO: Reynolds <br /> Meeting called to order at 6:30 P.M. in Room#2-F City-County Building by Vice Chair <br /> Ross to hold Public Hearing as published by Class II Notice. <br /> Klopp/Sayles to approve minutes of 7/20/00 and 7/27/00 as submitted. Motion carried <br /> 4-0. <br /> AUGUST PUBLIC HEARING ITEMS: <br /> #3099. Appeal by Stop-N-Go of Madison, Inc. for a variance from required setback from <br /> road and sideyards as provided by Sections 10.17(2), 10.16(4), 10.13(6) and 10.11(7) to <br /> permit gas island canopy at 2050 Fish Hatchery Road (County Highway D) being Lot <br /> #6, Fraust Plat Section 34, Town of Madison. <br /> IN FAVOR: R. Trachtenberg, S. McKernan OPPOSED: - - <br /> COMMUNICATION: Dane County Highway,Town board <br /> Klopp/Sayles to grant a variance of 10.5 feet from required setback to right-of-way of <br /> CTH D to permit gas island canopy to be located 9.5 feet from right of way line. <br /> Finding of fact: <br /> 1). Previous property owner had obtained a variance in 1987 for a canopy but zoning <br /> was not obtained. <br /> 2). Variance#1525, (1/22/87 granted canopy to be located at 16 feet from right-of-way. <br /> 3). Unpermitted canopy was erected 3 inches from right-of-way line. <br /> 4). Applicant's present proposal is to remove old canopy and install new canopy 2.5 feet <br /> from right-of-way line. <br /> 5). City of Madison allows canopy to be constructed up to right-of-way line(except on <br /> State or Federal Highways) <br /> Conclusion: <br /> 1). Variance preserves the zoning ordinance as much as possible without injustice to the <br /> applicant. <br /> 2). Variance is not contrary to rights of others or to the public. <br /> Motion Carried: 3 —0 (Ross—abstain) <br /> #3100. Appeal by Kevin Kavanaugh for a variance from maximum permitted <br /> wall/awning sign projection as provided by Section 10.84(2)to permit awning sign as <br /> C.,„„ proposed at 2920 Bryant Road in the SW 1/4 SE 1/4 Section 34, Town of Madison. <br />
