BOA MINUTES 6/22/00 <br /> PAGE 1 <br /> BOARD OF ADJUSTMENT <br /> MINUTES OF JUNE 22, 2000 <br /> PRESENT: Long, Sayles, Ross, Kay and Klopp <br /> ALSO: Reynolds <br /> Meeting called to order at 6:30 P.M. by Chair Kay, in Room 2-F City-County Building, <br /> to hold Public Hearing as published by Class II Notice. <br /> KLOPP/LONG to amend minutes of 5/25/00 RE: #3087 to read: Motion Carried 3—0 <br /> KKl (stain). <br /> MINUTES: KLOPP/LONG to approve mintues of 5/18 and 5/25/00 as amended <br /> Motion carried 4-1 (Ross, abstain). <br /> JUNE PUBLIC HEARING ITEMS: <br /> #3091. APPEAL BY LARS &BRENDA LEIN for a variance from required rearyard as <br /> provided by Sections 10.123(8)and 10.05(8)to permit residential addition as constructed at 722 <br /> Maple Grove Road in the SE 1/4 NW 1/4 Section 10,Town of Albion. <br /> IN FAVOR: L. Lein OPPOSED: --- COMMUNICATION: — <br /> SAYLES/KLOPP to grant variance of 20.3 feet from required rearyard to permit residential <br /> addition as constructed. <br /> Finding of Fact: <br /> 1). Applicant obtained Zoning Permit ZP 99-2473 which stated required rearyard would be 50 <br /> feet plus. <br /> 2). Addition replaces old"summer kitchen"with new kitchen and basement under. <br /> 3). Addition is 1-story and 28'x56'. <br /> 4). A rezone to R-3 would alleviate need for variance, but remove applicant from Farmland <br /> Preservation Program participation. <br /> 5). Completed construction and lot line discrepency are not factors of granting this request. <br /> Conclusion: <br /> 1). Variance preserves the Zoning Ordinance as much as possible without injustice to applicant. <br /> 2). Variance is not contrary to rights of others or to the public interest. <br /> Motion carried-5-0. <br /> #3092. APPEAL BY ROBERT&VIRGINIA KOM1NIAK for a variance from required setback <br /> from road and maximum lot coverage as provided by Sections 10.17(5), 11.03(1)and 10.05(5)to <br /> permit garage addition to existing residence as proposed at 4324 Jordan Drive being Lot#30, <br /> Block#1,Brictson Park, Section 8,Town of Dunn. <br /> IN FAVOR: R. &V. Kominiak OPPOSED: --- COMMUNICATION: Town Board. <br />
