BOA MINUTES 6/22/00 <br /> PAGE 2 <br /> SAYLES/ROSS to grant variance of 16.2 feet from required setback to right-of-way of Jordan <br /> Drive and variance of 400 square feet from maximum allowable lot coverage to permit addition <br /> as amended. <br /> Finding of fact: <br /> 1). Applicant proposes to add a 2-car garage to existing residence. <br /> 2) .When Brictson Park was platted original right-of-way setback was 20 feet, however <br /> subsequent road widening increased setback to 30 feet. <br /> 3). Existing 1-car garage,under bedroom,will be converted to living space. <br /> 4). Proposed 26x24 garage will exceed allowable maximum lot coverage by 400 square feet after <br /> applicant reduces deck sizes. <br /> 5). Lot is 178'x40'and steeply sloped away from road. <br /> Conclusion: <br /> 1). Proven case of unnecessary hardship <br /> 2). Variance is not contrary to rights of others or to the public interest. Applicant has an approximately 0.47 acre lot on the shores of Oak Springs Fish Hatchery and <br /> wishes to construct a new single family residence. <br /> 2). Minimum required setback to normal high watermark of Oak Springs Fish Hatchery is 75 <br /> feet. <br /> 3). Property has recorded deed restriction imposing that minimum required setback from road <br /> right-of-way as 50 feet and minimum dwelling size of 1400 square feet. <br /> 4). Property is under Zoning Ordinances of Village of DeForest Joint Board while Shoreland <br /> Zoning under jurisdiction of Dane County. <br /> 5). Appears applicant could reduce or eliminate need for variance with alteration of floor plan to <br /> be more consistant with buildable area of lot. <br /> Conclusion: <br /> 1). Unnecessary hardship was not proven. <br /> #3089.
