BOA 5/25/00 MINUTES <br /> PAGE 1 <br /> BOARD OF ADJUSTMENT <br /> MINUTES OF May 25,2000 <br /> PRESENT: Long, Sayles, Klopp &Kay <br /> ALSO: Reynolds <br /> Meeting called to order 6:30 P.M. by Chairman Kay, in Room 2-F City-County Building <br /> to hold Public Hearing as published by Class II Notice. <br /> MINUTES: <br /> SAYLES/KLOPP to approve minutes of 4/20 and 4/27/2000 as submitted. <br /> Motion carried. 4-0. <br /> MAY PUBLIC HEARING ITEMS: <br /> #3087. Appeal by Ludwig & Audrey Buechner for a variance from required setback <br /> from road as provided by Section 10.17(3) to permit replacement of storage building at <br /> 7665 Martinsville Road being Lot#1, CSM 1091 in the NE 1/4 SE 1/4 Section 7, Town <br /> of Springfield. <br /> IN FAVOR: L. & A Buechner OPPOSED: --- COMMUNICATION: Town <br /> Board <br /> SAYLES/LONG to deny requested variance of 27 feet from required setback to right-of- <br /> way of Martinsville Road to permit construction of accessory building as proposed. <br /> Finding of Fact: <br /> 1). Applicant owns property which held accessory building that encroached into road <br /> right-of-way. <br /> 2). Accessory building now removed and applicant wishes to reconstruct utilizing <br /> existing concrete foundation. <br /> 3). Lot is relatively flat and appears accessory structure could be located in complying <br /> location. <br /> 4). Proposed shed to be 14' x 24' and utilized for equipment storage. <br /> Conclusion: <br /> 1). Unnecessary hardship was not proven. Motion carried -4-0. <br /> #3088. Appeal by LaVonne J. Morgensen for a variance from required setback from <br /> normal high watermark as provided by Section 11.03(2)to permit new residence <br />
