Design change appears to provide adequate deck area without need for variance. Conclusion: SIDEYARD: 1) . Variance is not contrary to rights of others or to the public interest. 2) . Variance preserves the zoning ordinance as much as possible without injustice to applicant. DECK: 1) . Unnecessary hardship was not proven. #3069. Appeal by City of Madison for a variance from required maximum height permitted under the Dane County Regional Airport Height Limitation Zone as provided by Section 78 . 03 to permit construction crane for bridge repair at State Highway 113 (Packers Avenue) and Aberg Avenue in Section 31, City of Madison. The crane must be lowered below 915 feet (AMSL) , the maximum elevation allowed under the Height Limitation Zoning Ordinance (HLZO) , when not in use and during the hours between sunset and sunrise. 3) . The project coordinator must notify the airport prior to the initial commencement of crane operations and upon completion of the project. 4) . An on-site phone number must be provided to the airport allowing immediate communication between the airport and the construction site. 5) . Variance in effect July 5, 2000 thru November 30, 2000. 6) . Subject to all other necessary governmental agency approvals . Finding of Fact: 1) . Project is highway bridge re-construction at Packers and Aberg Avenues, City of Madison. 2) . Maximum height of structures, at this location is 40 feet, while project requires a 75 foot crane. 3) . FAA has found proposal not to be a hazard to air navigation. 4) . Crane needed for structural component replacement and will be lowered during non-work hours. Conclusion:
