BOA MINUTES 11/18/99 <br /> PAGE 5 <br /> (mw 2) . Zoning Inspector, on inspection, indicated that garage was <br /> in complying location and issued Certificate of Compliance. <br /> 3) . Subsequent survey to determine setback, for deck <br /> construction, discloses garage encroachment. <br /> 4) . Standard setback from platted road is 30 feet, however this <br /> being a corner lot is afforded a 23 foot minimum setback as per <br /> 10. 16 (5) (b) Dane County Code of Ordinance. <br /> 5) . Design change appears to provide adequate deck area without <br /> need for variance. <br /> Conclusion: <br /> SIDEYARD: 1) . Variance is not contrary to rights of others or <br /> to the public interest. <br /> 2) . Variance preserves the zoning ordinance as much as possible <br /> without injustice to applicant. <br /> DECK: 1) . Unnecessary hardship was not proven. <br /> #3069. Appeal by City of Madison for a variance from required <br /> maximum height permitted under the Dane County Regional Airport <br /> Height Limitation Zone as provided by Section 78 . 03 to permit <br /> construction crane for bridge repair at State Highway 113 <br /> (Packers Avenue) and Aberg Avenue in Section 31, City of <br /> Madison. <br /> IN FAVOR: K. Ballweg OPPOSED: --- COMMUNICATION: Dane <br /> County Airport, FAA <br /> ROSS/LONG to grant variance with conditions from maximum height <br /> 1LW of structures within the Airport Height Limit. <br /> Conditions: <br /> 1) . The temporary structure (crane) will be marked and/or <br /> lighted in accordance with FAA Advisory Circular 70/7460 1J, <br /> Chapters 3, 4, 5 and 13 . <br /> 2) . The crane must be lowered below 915 feet (AMSL) , the <br /> maximum elevation allowed under the Height Limitation Zoning <br /> Ordinance (HLZO) , when not in use and during the hours between <br /> sunset and sunrise. <br /> 3) . The project coordinator must notify the airport prior to the <br /> initial commencement of crane operations and upon completion of <br /> the project. <br /> 4) . An on-site phone number must be provided to the airport <br /> allowing immediate communication between the airport and the <br /> construction site. <br /> 5) . Variance in effect July 5, 2000 thru November 30, 2000. <br /> 6) . Subject to all other necessary governmental agency <br /> approvals . <br /> Finding of Fact: <br /> 1) . Project is highway bridge re-construction at Packers and <br /> Aberg Avenues, City of Madison. <br /> 2) . Maximum height of structures, at this location is 40 feet, <br /> while project requires a 75 foot crane. <br /> 3) . FAA has found proposal not to be a hazard to air <br /> navigation. <br /> 4) . Crane needed for structural component replacement and will <br /> be lowered during non-work hours. <br /> Conclusion: <br />
