BOA MINUTES 11/18/99 <br /> PAGE 4 <br /> KLOPP/SAYLES to deny requested variance from required right <br /> sideyard to permit residence as constructed. <br /> Finding of Fact: <br /> 1) . Applicant obtained Zoning Permit ZP 1998 2140 for new <br /> residence construction. <br /> 2) . Original site plan shows proposed residence location to be <br /> 13 feet from South lot line while actual construction is 7 .2 <br /> feet from North lot line. <br /> 3) . Construction revision was intended to distance residence <br /> with treeline. <br /> 4) . Lot area is 3 .26 acres and described as Lot #1, CSM #8197 . <br /> Conclusion: <br /> 1) . Unnecessary hardship was not proven. Motion carried - 5-0. <br /> #3067 . Appeal by Primrose Lutheran Church for a variance from <br /> required number of parking stalls, as provided by Section <br /> 10. 18 (5) to permit church expansion at 8770 Ridge Drive in the <br /> SE 1/4 NE 1/4 Section 28, Town of Primrose. <br /> IN FAVOR: A. King, K. Hanson OPPOSED: --- COMMUNICATION: <br /> Town Board <br /> ROSS/KAY to grant variance with condition of 55 stalls from <br /> required number of, on-premise, parking stalls for church usage. <br /> Condition: <br /> Variance remains in effect as long as Town of Primrose allows <br /> adequate church parking within its right-of-way. <br /> Finding of Fact: <br /> 1) . Church proposes to add 38' x 68' addition to for fellowship <br /> and recreation hall and class rooms. <br /> 2) . Present parking is allocated to Ridge Drive right-of-way. <br /> 3) . 10 off-street spaces will be designated between road and <br /> septic system. <br /> 4) . Church wishes to leave grassed areas available for church <br /> activities, such as picnicing, baseball and youth camping. <br /> 5) . Parking area in right-of-way offers 64 stalls with <br /> handicapped parking at front door. <br /> Conclusion: <br /> 1) . Variance is not contrary to rights of others or to the <br /> public interest. <br /> 2) . Variance preserves the zoning ordinance as much as possible <br /> without injustice to applicant. Motion carried - 5-0. <br /> #3068 . Appeal by Ronald Graney for a variance from required <br /> sideyard and setback from road as provided by Sections 10. 05 (7) <br /> and 10. 16 (5) to permit existing residence and proposed deck <br /> addition at 5140 Caton Lane being Lot #8, Yahara Heights Section <br /> 23, Town of Westport. <br /> IN FAVOR: B. Soper OPPOSED: --- COMMUNICATION: Town Board <br /> SAYLES/KLOPP to grant variance of 1 . 4 feet to required left <br /> sideyard to permit garage as constructed. Motion carried - 5-0. <br /> SAYLES/LONG to deny requested variance from required right-of- <br /> way to permit deck as proposed. Motion carried - 5-0. <br /> Finding of Fact: <br /> tior 1) . Applicant purchased residence in 1982 with attached garage <br /> that had been built in 1979 (Permit #31732) . <br />
