Suchomel OPPOSED: --- COMMUNICATION: Town <br /> Board <br /> SAYLES/LONG to deny requested sideyard variance to allow <br /> residence garage as constructed. <br /> Finding of Fact: <br /> 1) . Applicant obtained Zoning Permit ZP 1998-1943 for <br /> construction of garage in August 1998 . <br /> 2) . Site plan submitted with permit request shows building to <br /> be 4 feet minimum from left sideyard. <br /> 3) . Locational survey discloses garage to be 1. 7 feet to left <br /> sideyard. <br /> 4) . Applicant claims to have used power pole to determine <br /> sideyard. <br /> 5) . Requirement of zoning permit was to provide locational <br /> verification to department before completing construction. <br /> Conclusion: <br /> 1) . Unnecessary hardship was not proven. Motion carried - 5-0. <br /> #3064 . Appeal by William Garfoot for a variance from required <br /> setback from road as provided by Section 10. 17 (1) to permit <br /> duplex construction at 1650-1652 State Highway 92 (Washington <br /> Street) being Lot #5 and SW 1/2 Lot #6, Block #5, Village of <br /> (imr Mount Vernon, Section 34, Town of Springdale. <br /> IN FAVOR: W. Garfoot OPPOSED: --- COMMUNICATION: Town <br /> Board, Wisconsin D.O.T. <br /> ROSS/KLOPP to grant variance of 12 feet to required setback to <br /> centerline of State Highway 92 to allow residential construction <br /> as proposed. <br /> Finding of Fact: <br /> 1) . Property is made up of lots, in the Village of Mount <br /> Vernon, which were platted 150 years ago. <br /> 2) . Property is site of burned-out residence and applicant <br /> proposes new duplex construction. <br /> 3) . Septic location, required yards and setbacks from town <br /> roads limit buildable area. <br /> 4) . Applicant claims to have been advised by Department Staff <br /> that setback would be 42 feet to right-of-way with no mention of <br /> 100 feet, whichever is greater. <br /> Conclusion : <br /> a) . Variance preserves the zoning ordinance as much as possible <br /> without injustice to applicant. <br /> b) . Variance is not contrary to rights of others or to the <br /> public interest. Motion carried - 5-0. <br /> #3065 . Appeal by Steven & Pamela Brumm for a variance from <br /> required sideyard as provided by Section 10. 12 (7) and 10. 05 (7) <br /> to permit residence as constructed at 8690 CTH G being Lot #1, <br /> CSM #8197 in the SW 1/4 SW 1/4 Section 34, Town of Springdale. <br /> tor IN FAVOR: J.
