BOA MINUTES 11/18/99 <br /> PAGE 2 <br /> KLOPP/ROSS to grant variance of 306 stalls from required number <br /> of parking stalls. Motion carried - 5-0. <br /> ROSS/SAYLES to grant variance to allow wall signage on 3 sides <br /> of building as per permits issued in error. Motion carried - <br /> 5-0. <br /> SAYLES/KLOPP to deny variance from maximum height of wall sign <br /> to allow wall sign as located. Motion carried - 5-0. <br /> ROSS/LONG to grant variance, with condition from required <br /> sideyard to permit entrance canopy as constructed. <br /> Condition: <br /> That canopy contains no signage or advertising. Motion carried <br /> - 5-0. <br /> Finding of Fact: <br /> 1) . Applicant owns bowling establishment bounded by roads on 4 <br /> sides. <br /> 2) . Building is located in the Town of Madison while majority <br /> of parking is within City of Madison. <br /> 3) . The West side of building is only inches from municipal <br /> boundary. <br /> 4) . Applicant obtained 3 permits (issued in error) from Zoning <br /> Department for signage on 3 sides of building (S97-821, 822 & <br /> 823) . <br /> 5) . Applicant agrees to remove existing signage on West side of <br /> building. <br /> 6) . Establishment exceeds required parking with lands outside <br /> County jurisdiction. <br /> (1, 7) . Previous variance #2859 (8/28/97) denied reduction of <br /> number of parking stalls provided, in Township through <br /> construction of outdoor volleyball courts, also denied variances <br /> from maximum number allowed and maximum height of wall signs and <br /> granted sideyard variance for entryway. <br /> 8) . Ordinance Amendment #39, 1997-98 reduced the required <br /> number of parking stalls, but does not address parking outside <br /> the jurisdictional unit. <br /> 9) . Additional sign height was to accommodate lean-to <br /> volleyball court addition constructed without necessary permits . <br /> Conclusion: <br /> 1) . PARKING: a) . Variance preserves the zoning ordinance as <br /> much as possible without injustice to applicant. b) . Variance <br /> is not contrary to rights of others or to the public interest. <br /> 2) . NUMBER OF WALL SIGNS: a) . Variance is not contrary to <br /> rights of others or to the public interest. b) . Variance <br /> preserves the zoning ordinance as much as possible without <br /> injustice to applicant. <br /> 3) . HEIGHT OF WALL SIGN: a) . Unnecessary hardship was not <br /> proven. <br /> 4) .
