BOA 9/23/99 <br /> Page 1 <br /> BOARD OF ADJUSTMENT MINUTES <br /> September 23, 1999 <br /> PRESENT: Long, Kay, Klopp, Ross and Sayles . <br /> ALSO: Reynolds <br /> Meeting called to order at 6: 30 P.M. in Room #2-F by Vice <br /> Chair Ross to hold public hearing as published by Class II <br /> Notice. <br /> MINUTES: KLOPP/SAYLES to approve minutes of August 19, 1999 <br /> and August 26, 1999 as submitted. Motion carried - 4-0. <br /> SEPTEMBER PUBLIC HEARING ITEMS: <br /> #3049. Appeal by Terry Eder for a variance from required <br /> setback from road as provided by Section 10. 16 (5) (b) 2. to <br /> permit deck addition to residence at 501 Gannon Avenue being <br /> Lot #61, Block #14, Second Addition E.L. Gallagher Plat <br /> Section 5, Town of Blooming Grove. <br /> IN FAVOR: T. Eder OPPOSED: --- COMMUNICATION: Town <br /> Board <br /> SAYLES/ROSS to grant a variance of 7.5 feet± to permit deck <br /> addition as constructed. <br /> Finding of Fact: <br /> 1) . Identical Variance granted for same deck in August 1995 <br /> (#2658) to which permit not obtained. <br /> 2) . Present owner purchased property 1 1/2 years ago. <br /> 3) . Deck is emergency exit from kitchen area and not <br /> attached to ground 'by means of stairs. <br /> 4) . Property is in an area of numerous non-conforming <br /> structures with numerous variances being granted. <br /> Conclusion: <br /> 1) . Variance preserves the zoning ordinance as much as <br /> possible without injustice to applicant. <br /> 2) . Variance is not contrary to rights of others or to the <br /> public interest. <br /> Motion carried - 5-0. <br /> I <br /> wow <br />
