Motion carried - 5-0. <br /> JULY PUBLIC HEARING ITEMS: <br /> #3033. Appeal by Bill Garfoot for a variance from required <br /> lot area as provided by Section 10. 071 (4) to permit new <br /> duplex construction at 1650 Washington Street being Lot #5 <br /> and SW 1/2 Lot #6, Block 5, Byam' s Addition to Mount Vernon <br /> Section 34, Town of Springdale. <br /> IN FAVOR: B. Garfoot OPPOSED: --- COMMUNICATION: Town <br /> Board <br /> KLOPP/LONG to grant, with condition, Variance of 3665 square <br /> (IF feet from minimum required lot area for duplex construction. <br /> Condition: <br /> 1) . That each unit of proposed duplex be limited to 1 <br /> bedroom as per floor plan submitted. <br /> Finding of Fact: <br /> 1) . Applicant proposes duplex construction on existing <br /> substandard lot. <br /> 2) . Rezone to R-3A (to allow duplex use) is before Zoning <br /> and Natural Resources Committee for consideration on July <br /> 27, 1999. <br /> 3) . Property formerly had a single family residence on it, <br /> which was destroyed by fire. <br /> 4) . The plat of Mount Vernon was recorded in the mid-1850' s <br /> and lots are considered buildable-nonconforming. <br /> 5) . Property is in an area of numerous non-conforming lots <br /> with numerous variance approvals. <br /> Conclusion: <br /> 1) . Variance preserves the zoning ordinance as much as <br /> possible without injustice to applicant. <br /> 2) . Variance is not contrary to rights of others or to the <br /> public interest. Motion carried 5-0 . <br /> #3034 . Appeal by Teresa F. Greene for a variance from <br /> required setback from road and minimum rearyard as provided <br /> Igor by Sections 10. 16 (5) and 10. 07 (8) to permit new residence <br /> construction at 4868 Trantin Court being Lot #13, Block #6, <br />
