Variance is not contrary to rights of others oto the public interest. <br /> 2). Variance preserves the zoning ordinance as much as possible without injustice to applicant. <br />} <br /> APPEALS FROM PREVIOUS HEARINGS : <br /> #3023 Skipper Buds - Westport - 5/27/99 P.H. <br /> Appearances: B. Fleck, R. Rashleger and D. Powell <br /> LONG/SAYLES to deny requested variance from required setback to normal high water mark of <br /> Lake Mendota to permit above ground fuel storage tank as proposed. <br /> FINDING OF FACT; <br /> 1). Applicant proposes to locate fuel storage tank 25 feet from normal high water mark . <br /> 2). A 256 ft.X 125 ft. dry storage warehouse,which is under construction, limits tank location. <br /> 3). Proposed setback from main channel of Yahara river is 75 feet,while th erequested variance is <br /> from the ordinary high water mark of a wetland marsh area below the ordinary high water mark. <br /> 4). Proposed tank location is to facilitate fueling of boats from a dockside location.. <br /> 5). Existing tank and fueling operation is being relocated for enviromental and traffic pattern <br /> concerns. <br /> CONCLUSION: <br /> Unnecessary hardship was not proven.
