BOA 6/24/99 Page 2 <br /> Finding of Fact: <br /> 1). Applicant proposes basement and 2nd story addition to existing residence. <br /> 2). Sideyard of existing residence appears to be at the 5 foot minimum,the addition with siding <br /> and insulation may encroach slightly. <br /> 3). Required setback to Sunnyside St. is 20 feet and existing garage is consisered to be non- <br /> conforming as located. <br /> 4). Structure was previously a summer cottage converted to year round usage with several <br /> additions already. <br /> 5). Foundation consists of block and brick piers supporting wood girders that have slumped or <br /> shifted. <br /> Conclusions : <br /> 1). Variance preserves the zoning ordinance as much as possible without injustice to the <br /> applicant. <br /> 2). Variance is not contrary to the righs of others or to the public interest. <br /> #3031. Appeal by W. B. Von Rutenberg et al. for variances from required lot area and lot width, <br /> minimum sideyard and maximum square footage of accessory buildings as provided by Sections <br /> 11.03(1), 10.05(4), 10.07(7)and 10.04(1)to permit lot division by Certified Survey Map at 4940 <br /> tir Borchers Beach Road being Lot#1,Borcher's Beach,Lots 15, 16 and 17,Block 3,Morris Park <br /> and adjacent lands in the SE 1/4 NW 1/4 and NE 1/4 SW 1/4 Section 33,Town of Westport. <br /> IN FAVOR: J. Von Rutenberg OPPOSED: — COMMUNICATIONS: -- <br /> ROSS/LONG to grant a variance of 30+/- feet from required minimum lot width for proposed <br /> lot#1 and a variance of 5+/-feet from required mimimum lot width for proposed lot#2 to allow <br /> lot line adjustment as proposed. Motion carried 4-0. <br /> SAYLES/ROSS to grant a variance of 200 sq. ft. from maximum allowable square footage of <br /> accessory buildings to permit boathouse on a vacant lot after lot reconfiguration by certified <br /> survey map. Motion carried 4-0. <br /> P <br /> Finding of Fact: <br /> 1). Proposal is to combine 4 platted lots and vacated right of way into 2 lots by certified survey <br /> map. <br /> 2). Lot width variances are needed to reconfigure lots by certifed survey due to ordinance <br /> requirement of mimimum 100 foot lot width within shoreland areas. <br /> tor 3).
