BOA MINUTES 4t22/99 <br /> PAGE 1 <br /> BOARD OF ADJUSTMENT MINUTES <br /> APRIL 22, 1999 <br /> PRESENT: Long,Ross,Kay and Klopp <br /> ALSO: Reynolds. <br /> Meeting called to order at 6:35 P.M. in Room 2-F City-County Building by Chairman Kay <br /> to hold Public Hearing as published by Class II Notice <br /> MINUTES: KLOPP/ROSS to approve minutes of March 18, 1999 and March 25, 1999 <br /> as submitted. Motion carried-4-0. <br /> APRIL PUBLIC HEARING ITEMS: <br /> #3019. Appeal by Darrell Holcomb&David Oberg for a variance from required lot width and lot <br /> area as provided by Sections 10.05(4)and 11.03(1)to permit lot reconfiguration by Certified <br /> Survey Map at 118 Maple Street being Lots 9 through 13,Block 9,Edgerton Beach Park-Section <br /> 25,Town of Albion. <br /> IN FAVOR:N.Loniello OPPOSED: --- COMMUNICATION: Town Board <br /> Ross/Long to grant variances of 4.12 feet(for proposed Lot#1)and 32.96 feet(for proposed <br /> Lot#2)from required 100 feet minimum lot width in the shoreland district also to grant variances <br /> of 3,014 square feet(for proposed lot#1)and 6,629 square feet(for proposed Lot#2)to permit lot <br /> reconfiguration by CSM as requested. <br /> Finding of Fact: <br /> 1). Proposal is to combine(5)33 foot platted lots into 2 Certified Survey Lots. <br /> 2). Applicant constructed a new residence in violation of required sideyard setback and needs lot <br /> line adjustment to achieve compliance. <br /> 3). Board of Adjustment had previously denied requested sideyard Variance(Variance#2764- <br /> 8/22/96 P.H.)and approved previous lot area and width variances and no CSM was recorded <br /> within 1 year(Variance#2892- 10/20/97 P.H.). <br /> 4). Similar Variances have historically been granted by the Board of Adjustment as it prohibits <br /> higher density residential. <br /> Conclusion: <br /> 1). Variance preserves the zoning ordinance as much as possible without injustice to applicant. <br /> 2). Variance is not contrary to rights of others or to the public interest. <br /> Motion carried-4-0. <br />
