MA 5 <br /> PAM 2 <br /> #3020. Appeal by Denny&Kathy Layton for a variance from required setback from road as <br /> provided by Section 10.17(1)to permit alteration/addition to existing residence at 335 State <br /> Highway 106 in the NE 1/4 SE 1/4-Section 23,Town of Albion. <br /> IN FAVOR: D. Layton OPPOSED: --- COMMUNICATION: Town Board <br /> KAY/ICLOPP to grant with condition,a variance of 46±feet from required setback to centerline <br /> of STH 106 to allow alteration/addition to exist residence provided addition continue,and not <br /> exceed existing highway encroachment. <br /> Condition: <br /> 1).The addition shall be removed at the owner's expense if future road improvement requires <br /> additional right-of-way. <br /> Finding of Fact: <br /> 1). Applicant proposes to add 8 feet to and convert flat roof to pitched over existing 3 season <br /> porch. <br /> 2). Existing 11'x 16'porch has a flat roof and leaks during periods of precipitation. <br /> 3). Original residence constructed in 1904 and pre-dates the highway construction or any required <br /> setback requirement. <br /> 4). Floor plan,interior plumbing,well and septic system limit building area. <br /> 5). Entire residence is within required setback and any addition or alteration would require <br /> variance. <br /> Conclusion: <br /> tor 1). Variance preserves the zoning ordinance as much as possible without injustice to applicant. <br /> 2). Variance is not contrary to rights of others or to the public interest. <br /> Motion carried-4-0. <br /> #3021. Appeal by Donald&Diane Martinson for a variance from required setback from normal <br /> high watermark as provided Section 11.03(2)to permit addition to existing residence at 4181 Vilas <br /> Road in the NE 1/4 NE 1/4-Section 17,Town of Cottage Grove. <br /> IN FAVOR: D.Martinson, S.Anders OPPOSED: --- COMMUNICATION: Town Board. <br /> KLOPP/LONG to grant variance of 19 feet from required setback to normal high watermark to <br /> permit residence addition as proposed. <br /> Finding of Fact: <br /> 1). Applicant proposes to add first floor laundry,whirlpool and handicap accessible bathroom. <br /> 2). Handicapped family member unable to navigate basement stairs needs first floor laundry. <br /> 3). Setback requirement is to tributary to Little Door Creek which sees water from Spring thaw <br /> and Fall rains. <br /> 4). Property is restricted on 3 sides by Vilas Road, railroad right-of-way and Little Door <br /> Creek. <br /> Conclusion: <br /> 1). Variance preserves the zoning ordinance as much as possible without injustice to applicant. <br /> 2).
