BOA ADJUSTMENT MINUTES <br /> 1/28/99 Page 1 <br /> BOARD OF ADJUSTMENT MINUTES <br /> JANUARY 28, 1999 <br /> PRESENT: Long, Klopp, Kay, Ross and Bitzer <br /> ALSO: Reynolds and Gregorius <br /> Meeting called to order at 6: 30 P.M. by Chair Kay in Room <br /> 2-F City-County Building to hold Public Hearing as published <br /> by Class II Notice. <br /> Minutes : ROSS/LONG to approve minutes of 12/10/98 and <br /> 12/17/98 as submitted. Motion carried - 5-0 . <br /> JANUARY PUBLIC FEARING ITEMS: <br /> #3008 . Appeal by Park Street M & K LLC for a variances from <br /> required sideyard and rearyard as provided by Sections 10. 11 (7) <br /> and (8) , and 10. 14 (6) and (7) to permit accessory building as <br /> proposed at 2342 South Park Street (USH 151) being part of Lot <br /> 1, and Lots 2 and 3, Miller Park - Section 35, Town of Madison. <br /> IN FAVOR: K. Gilkey OPPOSED: --- COMMUNICATION: Town Board <br /> BITZER/KLOPP to grant, with condition, a variance of 6 feet from <br /> required side/rear yard as proposed. <br /> Condition: <br /> 1) . That structure is to be removed upon completion of <br /> groundwater remediation. <br /> Finding of Fact: <br /> 1) . Structure is needed to house monitoring and collection <br /> equipment. <br /> 2) . Property is a corner lot and variance would be same whether <br /> its side or rear yard request. <br /> 3) . Remediation process could take from 2-15 years to complete. <br /> 4) . Locating structure on West side of building would prevent <br /> delivery access to rear door and raise safety concerns. <br /> Conclusion: <br /> 1) . Variance preserves the Zoning Ordinance as much as possible <br /> without injustice to applicant. <br /> 2) . Variance is not contrary to rights of others or to the <br /> public interest. Motion carried 5-0. <br /> #3009. Appeal by Roxbury Sanitary District #1, for a Special <br /> Exception Permit as provided by Section 11. 05 (3) to permit <br /> filling, grading, etc. , within 300 feet of Blum' s Creek in the <br /> SW 1/4 SW 1/4 Section 16 and NE 1/4 SE 1/4 Section 17, Town of <br /> Roxbury. <br /> IN FAVOR: M. Morrow OPPOSED: --- COMMUNICATION: --- <br /> ROSS/KLOPP to grant, with conditions, permit to fill, grade and <br /> stream crossings as proposed. <br /> 1) . That plans and specifications be prepared by a licensed <br /> engineer within the scope of the application, and filed with <br /> the Zoning Department before commencement of any work. <br />
