BOA ADJUSTMENT MINUTES <br /> 1/28/99 Page 2 <br /> 2) . That all work be performed in compliance with approved <br /> tor engineering standards and all applicable governmental rules <br /> and regulations particularly Section 11 . 05 (4) of Dane - County <br /> Code of Ordinances. <br /> 3) . That there be filed with the Zoning Department a <br /> Certificate of compliance by a licensed engineer at the <br /> completion of the project. <br /> 4) . Subject to all other necessary governmental agency <br /> approvals . <br /> 5) . Inspection and approval by Zoning Department upon <br /> completion of project. <br /> 6) . At the discretion of the Board of Adjustment, <br /> inspection and approval by the Zoning Department during <br /> and/or upon completion may be required. <br /> 7) . Project permit valid April 15, 1999 thru October 15, <br /> 1999 contingent upon sanitary district notifying Zoning <br /> Department of commencement of activity within shoreland <br /> district and Staff will monitor for the several days of <br /> anticipated work. <br /> Finding of Fact : <br /> 1) . Project intended to install sanitary forcemain and <br /> outfall pipe within 300 feet of Blum' s Creek. <br /> 2) . Sanitary district with expansion will serve 161 <br /> members . <br /> 3) . Creek crossing (2) should be completed within 1 day <br /> each. <br /> 4) . Project utilizes water from creek, treats it at <br /> treatment plant and returns to creek. <br /> Conclusion: <br /> 1) . 1) . The project as planned, with specified conditions; <br /> will not result in substantial detriment to navigable waters <br /> by erosion, sedimentation, impairment of fish or aquatic <br /> life, or safe and healthful conditions . Motion carried - <br /> 5-0 . <br /> #3010. Appeal by Francis J. Vivian Trust for variances from <br /> required lot coverage, rearyard, sideyard, setback from road and <br /> required number parking spaces as provided by Sections <br /> 10. 14 (4) , 6 and 7, 10. 11 (7) , 10. 17 (3) and 10. 18 to permit lot <br /> division by Certified Survey Map at 2829 Perry Street in the SE <br /> 1/4 SW 1/4 Section 35, Town of Madison. <br /> IN FAVOR: F. Vivian, T. Matson, D. Hoff OPPOSED: --- <br /> COMMUNICATION: --- <br /> ROSS/BITZER to grant variances of 0. 6 feet for proposed Lot #1, <br /> and 0. 1 feet for proposed Lot #2 from required rearyard also to <br /> grant variances of 8 feet for proposed Lot #1 and 10 feet for <br /> proposed Lot #2 to permit existing buildings to remain after lot <br /> division as proposed. <br /> Finding of Fact: <br /> 1) . Proposal is to divide existing lot into 2 lots and to make <br /> conforming existing buildings . <br />
