BOARD OF ADJUSTMENT MINUTES <br /> November 19, 1998 <br /> PRESENT: Klopp, Kay, Ross, Long. <br /> ALSO: Reynolds <br /> Meeting called to order at 6: 33 P.M. by Chair Kay in <br /> 2-F City-County Building to hold Public Hearing as published <br /> by Class II Notice. <br /> MINUTES: LONG/KAY to amend minutes of October 22, 1998 RE: <br /> #2963 to add "Motion carried 5-0". Motion carried 4-0. <br /> LONG/KAY to approve minutes of November 12, 1998 and minutes <br /> of November 19, 1998 as amended - Motion carried - 4-0. <br /> NOVEMBER PUBLIC HEARING ITEMS: <br /> #2994. Appeal by Jim & Brenda Gray for a variance from required <br /> setback from road as provided by Section 10. 17 (1) to permit <br /> addition to existing residence at 7919 State Highway 188 in the <br /> SE 1/4 NW 1/4 Section 6, Town of Roxbury. <br /> IN-FAVOR: M. Wipperfurth OPPOSED: --- COMMUNICATION: <br /> KAY/ROSS to grant variance of 15 feet from required setback from <br /> centerline of State Highway 188 to allow structural alteration <br /> of that portion of existing residence also to deny any <br /> encroachment to required setback for proposed addition. <br /> Finding of Fact: <br /> 1) . Applicant proposes substantial addition to existing <br /> residence. <br /> 2) . Variance requested to allow new load bearing wall to <br /> support altered roof design. <br /> 3) . Original structure built in 1940' s. <br /> 4) . Lower Wisconsin Riverway Rules limit height of structure to <br /> 19 feet maximum or about 1 1/2 stories. <br /> 5) . Plan modification can accommodate proposed expansion in a <br /> conforming location. <br /> Conclusion: <br /> 1) . Variance preserves the Zoning Ordinance as much as possible <br /> without injustice to applicant. <br /> 2) . Variance is not contrary to rights of others or to the <br /> public interest. <br /> Motion carried - 4-0. <br /> #2995. Appeal by Laura & Paul Schwoerer for a variance from <br /> required setback from road as provided by Section 10. 17 (1) to <br /> permit residential garage construction at 866 US Highway 51 in <br /> the SE 1/4 SE 1/4 Section 4, Town of Dunkirk. <br />
