Heiliger OPPOSED: --- COMMUNICATION: Town <br /> Board <br /> KLOPP/LONG to hold request until December Hearing to allow <br /> applicant to explore alternatives to variance. Motion carried - <br /> 4-0. <br /> #2996. Appeal by Bertha Meyer Vinje for a variance from <br /> required setback from road as provided by Section 10.17 (3) to <br /> permit additions to existing residence at 4350 Smith Drive in <br /> the NW 1/4 SW 1/4 Section 8, Town of Deerfield. <br /> IN FAVOR: B. Vinje OPPOSED: --- COMMUNICATION: Town Board <br /> ROSS/LONG to grant variance of 7 feet from required setback to <br /> right-of-way of Smith Drive to permit second story addition to <br /> existing residence. <br /> Finding of Fact: <br /> 1) . Applicant proposes second story to encroach 18 inches <br /> nearer to required setback than does 1st story. <br /> 2) . Original structure was old school house constructed of <br /> stone in the 1880' s. <br /> 3) . Second story overhang is to protect eroding stone walls of <br /> 1st story. i <br /> 4) . Additional living space needed to accommodated expanded <br /> family. <br /> Conclusion: <br /> 1) . Variance is not contrary to rights of others or to the <br /> public interest. <br /> 2) . Variance preserves the Zoning Ordinance as much as possible <br /> without injustice to applicant. Motion carried 4-0. <br /> #2997 . Appeal by Madison Metropolitan Sewerage District for a <br /> Special Exception Permit as provided by Section 11.05 (3) to <br /> permit filling, grading, etc. , within 300 feet of a tributary to <br /> Badger Mill Creek in various 1/4 1/4' s Sections 2 and 3, Town of <br /> Verona and Section 34, Town of Middleton. <br /> IN FAVOR: N. Paschkey, J. Klawes OPPOSED: --- <br /> COMMUNICATION: Town of Verona. <br /> KLOPP/LONG to grant, with conditions, permit to fill, grade and <br /> stream crossings for sewer installation as proposed. <br /> Conditions: <br /> 1) . That plans and specifications be prepared by a licensed <br /> engineer within the scope of the application, and filed with <br /> the Zoning Department before commencement of any work. <br /> 2) . That all work be performed in compliance with approved <br /> engineering standards and all applicable governmental rules <br /> and regulations particularly Section 11 . 05 (4) of Dane County <br /> Code of Ordinances. <br /> 3) . That there be filed with the Zoning Department a <br /> Certificate of compliance by a licensed engineer at the <br /> completion of the project. <br /> 4) . Subject to all other necessary governmental agency <br /> approvals. <br /> 5.) . Inspection and approval by Zoning Department upon <br /> completion of project. <br />
