BOA MINUTES 10/22/98 <br /> PAGE 1 <br /> BOARD OF ADJUSTMENT MINUTES <br /> OCTOBER 22, 1998 <br /> PRESENT: Klopp, Kay, Ross, Long and Bitzer <br /> ALSO: Reynolds <br /> Meeting called to order at 6: 32 P.M. by Chair Kay in Room <br /> 2-F City-County Building to hold Public Hearing as published <br /> by Class II Notice. <br /> MINUTES: Bitzer/Ross to approve minutes as submitted. <br /> Motion carried - 5-0. <br /> #2988 . Appeal by Edward P. Johnson for a variance from <br /> required setback from normal high watermark as provided by <br /> Section 11 . 03 (2) to permit structural repair to existing <br /> residence at 2092 Barber Drive being Lot #15, Lincoln Park, <br /> Section 26, Town of Dunn. <br /> IN FAVOR: E. Johnson OPPOSED: --- COMMUNICATION: D.N.R. , <br /> 4irw Town Board. <br /> KLOPP/LONG to grant variance of 25.5 feet from setback to <br /> normal high watermark to permit structural repair of <br /> existing residence as proposed. <br /> Finding of Fact: <br /> 1) . Applicant proposes to replace sagging roof with new <br /> truss system. <br /> 2) . Residence is former cottage built in the mid-1920' s. <br /> 3) . Footprint of existing structure will remain unchanged. <br /> 4) . Structural repair/replacement is below 50% of assessed <br /> value of structure. <br /> Conclusion: <br /> 1) . Variance preserves the zoning ordinance as much as <br /> possible without injustice to applicant. <br /> 2) . Variance is not contrary to rights of others or to the <br /> public interest. <br /> Motion carried - 5-0. <br /> #2989. Appeal by Town of Westport Sewer Utility for a <br /> Special Exception Permit as provided by Section 11 . 05 (3) to <br /> permit filling, grading, etc. , within 300 feet of Lost Lake <br /> located at 3905, 3909 and 3915 South Meadow Drive being Lots <br /> 11 and 12 South Meadow and Lot #1, CSM #5746 located in the <br /> SW ' SW ;-4 Section 32, Town of Westport. <br />
