Quam OPPOSED: --- COMMUNICATION: Town <br /> Board <br /> ROSS/KLOPP to grant with conditions permit to fill and grade <br /> associated with sewer installation as proposed. <br /> Conditions: <br /> 1) . That plans and specifications be prepared by a licensed <br /> engineer within the scope of the application, and filed with <br /> the Zoning Department before commencement of any work. <br /> 2) . That all work be performed in compliance with approved <br /> engineering standards and all applicable governmental rules <br /> and regulations particularly Section 11 . 05 (4) of Dane County <br /> Code of Ordinances. <br /> 3) . That there be filed with the Zoning Department a <br /> Certificate of compliance by a licensed engineer at the <br /> completion of the project. <br /> 4) . Subject to all other necessary governmental agency <br /> approvals . <br /> 5) . Inspection and approval by Zoning Department upon <br /> completion of project. <br /> 6) . At the discretion of the Board of Adjustment, <br /> inspection and approval by the Zoning Department during <br /> and/or upon completion may be required. <br /> 7) . Permit valid December 1, 1998 with completion and <br /> certification deadline of January 1, 1999. <br /> Finding of fact: <br /> 1) . Project involves extending sewer and water lines to <br /> include 3 additional lots. <br /> 2) . Project is in a flat area and the chance of eroded <br /> materials leaving the site are slight. <br /> 3) . Property is within 300 feet of "Lost Lake". <br /> 4) . Engineering provided by the Mayo Corporation who is <br /> engineer for the Town of Westport. <br /> Conclusion: <br /> 1) . The project as planned, with specified conditions; will <br /> not result in substantial detriment to navigable waters by <br /> erosion, sedimentation, impairment of fish or aquatic life, <br /> or safe and healthful conditions. Motion carried - 5-0. <br /> #2990. Appeal by Duane Van Haren dba Out of Sight Storage <br /> LLC for a variance from required setback from road as <br /> provided by Section 10. 17 (1) to permit mini-warehouse as <br /> constructed, located at 7482 USH Highway 14 in the NW SE 1.4 <br /> Section 8, Town of Middleton. <br /> IN FAVOR: D. Van Haren, A. Van Haren <br /> KLOPP/BITZER to deny requested variance of 12 .3 feet to <br /> required setback to centerline of USH 14 to permit building <br /> as constructed. <br /> Finding of fact: <br /> 1) . Applicant has constructed a building 120 feet long and <br /> 50 feet wide to be utilized as a mini-warehouse. <br />
