The Town of Cross Plains Land Use Plan, adopted May 19, <br /> 1981, includes the following policies regarding non-farm <br /> development in Agricultural Preservation Districts: "Lands in <br /> the agricultural district should not be rezoned for non-farm <br /> residential development at an overall density of greater than <br /> one dwelling per 35 acres owned as of the date of this plan." <br /> It is clear from this wording that the Town and County Boards <br /> intended this policy to apply to all acreage under common <br /> ownership in the town, not just to contiguous legal parcels. <br /> Conclusion: <br /> 1) . To sustain the Zoning Administrator' s Interpretation of <br /> zoning lot. Motion carried - 4-0. (Bitzer - abstain) . <br /> #3003. Appeal by Edward Illgen for a Special Exception Permit <br /> as provided by Section 11.05 (3) to permit filling, grading, <br /> etc. , within 300 feet of Lake Waubesa on property located at <br /> 4328 McConnell Street, in the NE 1/4 SE 1/4, Section 5, Town of <br /> Dunn. <br /> IN FAVOR: E. Illgen, C. Gombar, E. Culles OPPOSED: --- Town <br /> Board <br /> BITZER/ROSS to grant, with conditions, permit to fill and grade <br /> to allow for lot drainage after construction of new residence. <br /> Conditions: <br /> 1) . That plans and specifications be prepared by a licensed <br /> engineer within the scope of the application, and filed with <br /> the Zoning Department before commencement of any work. <br /> 2) . That all work be performed in compliance with approved <br /> engineering standards and all applicable governmental rules <br /> and regulations particularly Section 11 .05 (4) of Dane County <br /> Code of Ordinances. <br /> 3) . That there be filed with the Zoning Department a <br /> Certificate of compliance by a licensed engineer at the <br /> completion of the project. <br /> 4) . Subject to all other necessary governmental agency <br /> approvals. <br /> 5) . Inspection and approval by Zoning Department upon <br /> completion of project. <br /> 6) . At the discretion of the Board of Adjustment, <br /> inspection and approval by the Zoning Department during <br />■ and/or upon completion may be required. <br /> 7) . That applicant immediately install erosion control <br /> devices. <br /> 8) . Project commencing April 15, 1999 with completion and <br /> certification deadline of April 30, 1999. <br /> 9) . Subject to Staff approval of revised/amended plan. <br /> Finding of fact: <br /> 1) . Applicant has amended plan to include a swale on both <br /> sides of property to divert run-off from neighbor' s <br /> property. <br />
