BOA MINUTES 12/17/98 <br /> PAGE 4 <br /> 2) . Work, except for seed and mulching has been completed <br /> without permit. <br /> 3) . Applicant is out-of-state builder and unfamiliar with <br /> laws of Dane County. <br /> 4) . Excavated foundation material was utilized to fill lot. <br /> 5) . Engineering provided by Cleve Gombar, Professional <br /> Engineer. <br /> Conclusion: <br /> 1) . 1) . The project as planned, with specified conditions; <br /> will not result in substantial detriment to navigable waters <br /> by erosion, sedimentation, impairment of fish or aquatic <br /> life, or safe and healthful conditions. Motion carried - <br /> 5-0. <br /> #3004. Appeal by Robert & Honner Cooper for a Special Exception <br /> Permit as provided by Section 11.05 (3) to permit filling, <br /> grading, etc. , within 300 feet of Lake Mendota on property <br /> located at 4842 Morris Court, being Lots 14, 15 and part Of Lot <br /> #13, Block 1, Morris Park, Section 33, Town of Westport. <br /> IN FAVOR: P. Saiki, D. Kozel, S. Wayland OPPOSED: --- <br /> COMMUNICATION: Town Board. <br /> KAY/ROSS to grant, with conditions, permit to fill, grade and <br /> retaining walls as proposed to allow lot drainage after <br /> construction of new residence. <br /> 1) . That plans and specifications be prepared by a licensed <br /> engineer within the scope of the application, and filed with <br /> the Zoning Department before commencement of any work. <br /> 2) . That all work be performed in compliance with approved <br /> engineering standards and all applicable governmental rules <br /> and regulations particularly Section 11 .05 (4) of Dane County <br /> Code of Ordinances. <br /> 3) . That there be filed with the Zoning Department a <br /> Certificate of compliance by a licensed engineer at the <br /> completion of the project. <br /> 4) . Subject to all other necessary governmental agency <br /> approvals. <br /> 5) . Inspection and approval by Zoning Department upon <br /> completion of project. <br /> 6) . At the discretion of the Board of Adjustment, <br /> inspection and approval by the Zoning Department during <br /> and/or upon completion may be required. <br /> 7) . Permit valid April 15, 1999 with completion and <br /> certification deadline of July 1, 1999. <br /> Finding of fact: <br /> 1) . Proposal is to construct a new residence on a very <br /> steep lake property. <br /> 2) . Excavated materials will be bermed between excavation <br /> site and Lake Mendota. <br /> 3) .
