BOA MINUTES 8/27/98 <br /> Page 7 <br /> 1) . Proposed building will replace a 40 foot x 154 foot shed <br /> destroyed by wind storm on May 31, 1998. <br /> 2) . Structure to be used for machinery and hay storage for farm <br /> operation. <br /> 3) . The size of farm equipment utilized necessitates large <br /> buildings and ample room to manuever. <br /> 4) . Property slopes downward as location moves away from road. <br /> CONCLUSION: <br /> 1) . Variance preserves the zoning ordinance as much as possible <br /> without injustice to applicant. <br /> 2) . Variance is not contrary to rights of others or to the <br /> public interest. <br /> Motion carried - 5-0. <br /> APPEALS FROM PREVIOUS HEARINGS: <br /> #2964. Bailey - Blooming Grove - 7/23/98 P.H. <br /> IN FAVOR: J. Bailey <br /> ROSS/KLOPP to grant a variance with condition of 4, 600 square <br /> feet from required minimum lot area, a variance of 35 feet from <br /> required minimum lot and a variance of 2 feet from minimum <br /> required sideyard. <br /> CONDITION: <br /> 1) . Subject to all other necessary governmental agency <br /> approvals. <br /> FINDING OF FACT: <br /> 1) . Applicant has existing 2-story residence and wishes to <br /> utilize as a duplex. <br /> 2) . Testimony is that residence was previously utilized as a <br /> duplex however used for single family residence during <br /> applicant's ownership. <br /> 3) . A small fire escape from 2nd floor is only change <br /> anticipated to existing structure. <br /> 4) . Applicant is proceeding with rezone Petition #7285 to <br /> change zoning to R-3A. <br /> CONCLUSION: <br /> 1) . Variance is not contrary to rights of others or to the <br /> public interest. <br /> 2) . Variance preserves the zoning ordinance as much as possible <br /> without injustice to applicant. <br /> Motion carried - 3-2. (Long & Kay - no) . <br /> #2958. Applicant has downsized plans to achieve minimal variances <br /> requested. <br /> 2) . Request is similar to many others having been approved in <br /> same locale. <br />
