BOA MINUTES 7/23/98 <br /> Page 1 <br /> BOARD OF ADJUSTMENT MINUTES <br /> JULY 23, 1998 <br /> PRESENT: Klopp, Kay, Ross and Long <br /> ALSO: Reynolds <br /> Meeting called to order at 6: 32 P.M. by Chair Kay in Room <br /> 2-F to hold Public Hearing as published by Class II Notice. <br /> MINUTES: LONG/ROSS to delete #2 of finding of fact of <br /> Appeal #2947 of minutes of June 25, 1998. Motion carried - <br /> 4-0. <br /> KLOPP/LONG to approve minutes of June 18, 1998 as submitted <br /> and minutes of June 25, 1998 as amended. Motion carried - <br /> 4-0. <br /> JULY PUBLIC HEARING ITEMS: <br /> #2955 . Appeal by Richard A. Marshall for variances from <br /> required setback to normal highwater mark and sideyard as <br /> provided by Sections 11.03 (2) and 10.07 (7) to permit <br /> addition/alteration of existing residence at 1930 Barber Drive <br /> being Lots 23 Rock Elm Park Extension and 23A Addition to Rock <br /> Elm Park Extension, Section 26, Town of Dunn. <br /> IN FAVOR: R. Marshall OPPOSED: --- COMMUNICATION: Town <br /> Board, B. Feole, W. Wiegand <br /> * Applicant withdraws requested variance from setback to normal <br /> high watermark. <br /> KLOPP/ROSS to grant a variance of 0.5 feet from required left <br /> sideyard to permit addition to existing residence as proposed. <br /> Finding of Fact: <br /> 1) . Applicant proposes second story addition over existing 840 <br /> square foot residence. <br /> 2) . The 3-season porch on left side of residence will be <br /> removed and reconstructed in code complying location. <br /> 3) . Applicant withdraws any consideration of setback from <br /> normal high watermark as existing deck is to remain undisturbed. <br /> 4) . No earth disturbing activity will take place - all work on <br /> existing foundation. <br /> 5) . Property is in an area of numerous non-conforming <br /> structures with numerous variances granted. <br /> Conclusion: <br /> 1) . Variance preserves the Zoning Ordinance as much as possible <br /> without injustice to applicant. <br /> 2) . Variance is not contrary to rights of others or to the <br /> public interest. Motion carried - 4-0. <br />
