BOA MINUTES 7/23/98 <br /> Page 2 <br /> #2956. Appeal by John Dimpfl for a variance from required <br /> setback to road as provided by Section 10.17 (1) to permit entry <br /> addition to existing residence at 4430 STH 78 in the SW 1/4 <br /> NW 1/4 - Section 12, Town of Vermont. <br /> IN FAVOR: J. Dimpfl OPPOSED: <br /> ROSS/KLOpp to grant a variance of 5t feet required Town <br /> to right-of-way of State Highway 78 to permit deck addition to <br /> existing residence as proposed. <br /> Finding of Fact: <br /> 1) . Proposed deck to be constructed behind existing residence, <br /> 2/3 of existing residence presently within required setback. <br /> 2) . Existing residence was former schoolhouse built in 1912 and <br /> pre-date State Highway dedication. <br /> 3) . . There is presently a 4 foot drop from rear door, to the <br /> ground. <br /> 4) . Second access needed to rear of residence serves as an <br /> emergency exit as required by building code. <br /> Conclusion: <br /> 1) . Variance is not contrary to rights of others or to the <br /> public interest. <br /> 2) . Variance preserves the Zoning Ordinance as much as possible <br /> without injustice to applicant. Motion carried - 4-0. <br /> #2958. Appeal by Edward R. & Phyllis M. Tennell for variances <br /> from required setback from road, sideyard and maximum lot <br /> coverage as provided by Section 10.17 (5) , 10.16 (5) , 11.03 (1) , <br /> and 10.05 (•5) to permit residential garage addition at 4200 <br /> Morris Park Road being W 1/2 Lot #22, Morris Park, Section 9, <br /> Town of Dunn. <br /> IN FAVOR: R. Kling OPPOSED: --- <br /> COMMUNICATION: Town Board <br /> KLOPP/LONG to hold request in abeyance until August Hearing to <br /> allow contractor and owner to discuss plan options. Motion <br /> carried - 3-1. (Kay - no) . <br /> #2960. Appeal by Firststar Bank for a variance from required <br /> setback from right-of-way for sign as provided by Section <br /> 10.83 (1) to permit expansion of existing signage at 3461 County <br /> Highway BB (Cottage Grove Road) being Lot #2, CSM 353 in the NE <br /> 1/4 SE 1/4, Section 11, Town of Blooming Grove. <br /> IN FAVOR: J. Maertz OPPOSED: <br /> Board --- COMMUNICATION: Town <br /> ROSS/LONG to deny requested variance from right-of-way line of <br /> County Highway BB to permit pylon sign as erected and requested <br /> addition to. <br /> Finding of Fact• <br /> 1) . On-premise pylon sign erected in 1992 (S92-67) in violation <br /> of required setback to right-of-way. <br /> 2) . Minimum setback to right-of-way for any signage is 5 feet. <br /> 3) . Proposal is to add additional sign to existing, illegally <br /> located pylon. <br />
