Middlecamp OPPOSED: --- COMMUNICATION: Town Board KLOPP/RAY to grant, with condition, a variance of 16.1 feet from required setback to right-of-way of North Street to permit canopy addition to existing building as proposed. Condition: 1) . That canopy support posts have curb surround or similar means of preventing the motoring public from damaging them. Finding of Fact: 1) . Proposal is for a 30' x 22' canopy to protect drive-up customers of donation center for thrift store. 2) . 2 Support pillars are only physical or visual obstruction into required setback. 3) . Drive-up location is dictated by existing doors and topography of opposite side of building. 4) . North Street is a lightly traveled dead-end serving 3 residences to the West. 5) . Property is in an area of numerous nonconforming lots with numerous variances granted. Conclusion: 1) . Variance preserves the Zoning Ordinance as much as possible without injustice to applicant. 2) . Variance is not contrary to rights of others or to the public interest. Motion carried - 4-0. #2962 .
