BOA MINUTES 7/23/98 <br /> Page 6 <br /> 1) . Applicant proposes to divide a <br /> PP p p oses portion of family farm on <br /> which to build a retirement home. <br /> 2) . Property is bounded by highways on 3 sides, State Highway <br /> 18 & 151, Town Hall Road and Ridgeview Road. <br /> 3) . Ordinance requires (10.045 Dane County Code of Ordinance) <br /> noise barriers on State and Federal Highways to drop noise <br /> levels for new residential development below 67 decibels. <br /> 4) . Applicant proposes to construct residence atop a hill on <br /> property which acts to lower decibel readings to a point that <br /> variance maybe unnecessary. <br /> 5) . Ordinance and Wisconsin Administration Code are not very <br /> specific on methodology to be utilized in determining noise <br /> levels. <br /> Conclusion: <br /> 1) . Variance is not contrary to rights of others or to the <br /> public interest. <br /> 2) . Variance preserves the zoning ordinance as much as possible <br /> without injustice to applicant. Motion carried 4-0. <br /> #2966. Appeal by Town of Westport for a Special Exception <br /> Permit as provided by Section 11. 05 (3) to permit filling, <br /> grading, etc. , within 300 feet of The Yahara River located in <br /> the SW 1/4 SE 1/4, Section 22 and the NW 1/4 NE 1/4 Section 27, <br /> Town of Westport. <br /> IN FAVOR: R. Quam OPPOSED: --- COMMUNICATION: Town Board <br /> KLOPP/LONG to grant, with conditions, permit to fill and grade <br /> for road construction and storm water run-off as proposed. <br /> Conditions: <br /> 1) . That plans and specifications be prepared by a licensed <br /> engineer within the scope of the application, and filed with <br /> the Zoning Department before commencement of any work. <br /> 2) . That all work be performed in compliance with approved <br /> engineering standards and all applicable governmental rules <br /> and regulations particularly Section 11 . 05 (4) of Dane County <br /> Code of Ordinances . <br /> 3) . That there be filed with the Zoning Department a <br /> Certificate of compliance by a licensed engineer at the <br /> completion of the project. <br /> 4) . Subject to all other necessary governmental agency <br /> approvals . <br /> 5) . Inspection and approval by Zoning Department upon <br /> completion of project. <br /> 6) . At the discretion of the Board of Adjustment, <br /> inspection and approval by the Zoning Department during <br /> and/or upon completion may be required. <br /> 7) . Permit valid August 10, 1998 with completion and <br /> certification by October 15, 1998 <br /> Finding of Fact: <br /> 1) . Project entails road improvement by slight realignment, <br /> raising grade and repaving. Also, storm water run-off to <br /> remove standing water. <br />
