Property is bounded by highways on 3 sides, State Highway 18 & 151, Town Hall Road and Ridgeview Road. 3) . Ordinance requires (10.045 Dane County Code of Ordinance) noise barriers on State and Federal Highways to drop noise levels for new residential development below 67 decibels. 4) . Applicant proposes to construct residence atop a hill on property which acts to lower decibel readings to a point that variance maybe unnecessary. 5) . Ordinance and Wisconsin Administration Code are not very specific on methodology to be utilized in determining noise levels. Conclusion: 1) . Variance is not contrary to rights of others or to the public interest. 2) . Variance preserves the zoning ordinance as much as possible without injustice to applicant. Motion carried 4-0. #2966. Appeal by Town of Westport for a Special Exception Permit as provided by Section 11. 05 (3) to permit filling, grading, etc. , within 300 feet of The Yahara River located in the SW 1/4 SE 1/4, Section 22 and the NW 1/4 NE 1/4 Section 27, Town of Westport. That plans and specifications be prepared by a licensed engineer within the scope of the application, and filed with the Zoning Department before commencement of any work. 2) . That all work be performed in compliance with approved engineering standards and all applicable governmental rules and regulations particularly Section 11 . 05 (4) of Dane County Code of Ordinances . 3) . That there be filed with the Zoning Department a Certificate of compliance by a licensed engineer at the completion of the project. 4) . Subject to all other necessary governmental agency approvals . 5) . Inspection and approval by Zoning Department upon completion of project. 6) . At the discretion of the Board of Adjustment, inspection and approval by the Zoning Department during and/or upon completion may be required. 7) . Permit valid August 10, 1998 with completion and certification by October 15, 1998 Finding of Fact: 1) . Project entails road improvement by slight realignment, raising grade and repaving. Also, storm water run-off to remove standing water.
