Project is within 300 feet of Yahara River. <br /> 4) . All work in compliance with Wisconsin Department of <br /> Transportation, Division of Highway, standards. <br /> Conclusion: <br /> 1) . The project as planned, with specified conditions; will <br /> not result in substantial detriment to navigable waters by <br /> erosion, sedimentation, impairment of fish or aquatic life, <br /> or safe and healthful conditions. Motion carried <br /> - 4-0. <br /> #2967. Appeal by Robert and Ann Somermeyer for a variance from <br /> required setback from road and maximum lot coverage as provided <br /> 1 by Sections 10. 17 (5) , 11.03 (1) and 10.05 (5) <br /> addition/alteration of existing residence ato3190 Aalseth Lane <br /> being Lot #16, Camp Dewey, Section 25, Town of Dunn. <br /> IN FAVOR: B. Applicant had previous variance <br /> denied right side yard and granted 8.(5#2841 <br /> feet 6/26/97 <br /> required setback to right-of-way of Aalseth Lane. <br /> 2) . Present application lessens required variance from right- <br /> of-way and asks for variance from maximum lot coverage to <br /> expanded residence and deck. <br /> 3) . Applicant's assertion of misinformation by Zoning Department <br /> Staff was unsubstantiated. <br /> 4) . Applicant's revised floor plan and site plan created need <br /> for lot coverage variance. <br /> 5) . Shoreland Zoning District allows 30% maximum lot area <br /> coverage, requested variance is to allow 35% lot coverage. <br /> 6) . Second story addition increases living area without <br /> increasing lot coverage. <br /> Conclusion: <br /> Setback: 1) . Variance preserves the zoning ordinance as much <br /> as possible without injustice to applicant. <br /> 2) . Variance is not contrary to rights of others or to the <br /> public interest. <br /> Lot Coverage: 1) . Unnecessary hardship was not proven. <br /> APPEALS FROM PREVIOUS HEARINGS: <br /> #2930.
