Zoning Administrator Appeal - Montrose - 6/25/98 P.H. <br /> ROSS/LONG to reverse the Interpretation of the Dane County <br /> Zoning Administrator as it pertains to student radio towers and <br /> find that they do not qualify as governmental uses. <br /> Findin of Fact• <br /> 1) . The University of Wisconsin had requested a conditional use <br /> permit (#1480) for a governmental use radio tower for the <br /> student run radio station. <br /> 2) . The Dane County Zoning and Natural Resources Committee <br /> granted said requested conditional use permit for governmental <br /> use - tower site. <br /> 3) . Communication tower locations are specifically addressed in <br /> Section 10.194 Dane County Code Ordinance, as conditional uses, <br /> however tower sites are not conditional use permits in the A-i <br /> Exclusive District. <br /> 4) . Section 10.01 (23h) is not determinative as to the <br /> definition of governmental uses and historically the Zoning <br /> Administrator has ruled that such university affiliation was <br /> sufficient to be deemed governmental use. <br /> 5) . Testimony failed to show operation of a student radio <br /> station by the University of Wisconsin is an intregal part of <br /> its educational mission. <br /> Conclusion: <br /> 1) . To overturn the Interpretation of the Dane County Zoning <br /> Administrator as it pertains to governmental use and the <br /> University of Wisconsin student radio tower.
